(e) any failure by Douglas to cooperate in providing access to the Property for cleanup and <br /> abatement, monitoring, construction, maintenance, and repair of any necessary cleanup and abatement or <br /> monitoring system required by the Board; <br /> (f) criminal liability; <br /> (g) liability for violations of local, state, or federal law or regulations. <br /> This reservation by the Board shall be separately and distinctly applied with respect to Douglas <br /> and his successors and assigns,the intent being that failure by a particular Released Parry to comply with <br /> any applicable requirement shall not render the Board inapplicable to any other Released Parry. <br /> 4.4. Other Persons. Nothing in this Agreement is intended as a release or covenant not to sue for <br /> any claim or cause of action, administrative or judicial, civil or criminal, past or future, in law or equity, <br /> which the Board may have against any person, firm, corporation, or other entity not a party to this <br /> Agreement. <br /> 4.5 Other Actions. Nothing in this Aareement is intended to limit the right of the Board to <br /> undertake or require cleanup and abatement actions at the Property, however, Douglas' cleanup and <br /> abatement obligations pertaining to the Property are limited to those described in this Agreement. <br /> Douglas acknowledges that it is purchasing property where cleanup and abatement actions are required. <br /> 4.6. Government Liabilities. The State of California shall not be liable for any injuries or <br /> damages to persons or property resulting from acts or omission of Douglas, or related parties, in carrying <br /> out activities pursuant to this Agreement, nor shall the State of California be held as a party to any <br /> contract entered into by Douglas or its agents in carrying out activities pursuant to this Agreement. <br /> V. CERTIFICATION <br /> 5. By entering into this Agreement,Douglas certifies that to the best of its knowledge and belief <br /> it has fully and accurately disclosed to the Board all information known to Douglas which relates in any <br /> way to the Known Conditions or any past or potential future discharge or waste at or from the Property <br /> and to its qualification for this Agreement. Douglas also certifies that to the best of its knowledge and <br /> belief it has not caused or contributed to a discharge of waste at the Property. If the Board determines <br /> that information provided by Douglas is not materially accurate and complete,the Covenant not to Sue <br /> in Section IV of this Agreement shall be null and void and the Board reserves the rights it may otherwise <br /> have against Douglas. <br /> VI. GENERAL PROVISIONS <br /> 6.1 Qualified Professionals. The work performed pursuant to this Agreement shall be by or <br /> under the direction of qualified professionals, with expertise in the actions to be performed, and in <br /> conformance with applicable state law. <br />
