in or near the site and may use the grasslands in the site for foraging.
Burrowing owls could nest in the site if burrow habitat is available and
western pond turtle may be present within Duck Creek.
• Standard Take Avoidance measures outlined in the HCP for nesting
Swainson's hawks and burrowing owl will be required, if identified
necessary by SJCOG in the ITMMs. These will include pre -construction
surveys for nesting Swainson's hawks within 0.5 miles of the site for
construction activities between March 1 and September 15 and pre -
construction surveys for nesting burrowing owls within 250 feet of the site
for construction activities commencing from February 1 through August
31. If active nests are found, temporal restrictions on construction may be
required.
• Standard Take Avoidance measures outlined in the HCP for nesting white-
tailed kite will be required, if identified necessary by SJCOG in the ITMMs.
These would include pre -construction surveys for nesting white-tailed kites
within 100 feet of the site for construction activities during the nesting
season. If active nests are found, temporal restrictions on construction
may be required.
• The project will also need to obtain a buffer reduction for western pond
turtle to allow work adjacent to Duck Creek. Standard Take Avoidance
measures outlined in the HCP for nesting western pond turtle, primarily
consisting of pre -construction surveys, are expected to be included in the
ITMMs.
• Due to a lack of suitable habitat, giant garter snake is not expected to
occur in the site. Nevertheless, standard Take Avoidance measures for
giant garter snake outlined in the HCP, primarily consisting of pre -
construction surveys, are expected to be included in the ITMMs. The
3009 Pock Lane: Biology 26 November 24, 2021
