project will likely also need to obtain a buffer reduction for giant garter <br />snake to allow work adjacent to Duck Creek. <br />• Trees and grasslands in the site could be used by birds protected by the <br />Migratory Bird Treaty Act of 1918 and/or Fish and Game Code of <br />California. If tree removal is scheduled during the nesting season of <br />raptors (January 1 through July 31), a pre -construction survey for nesting <br />raptors is recommended. If other vegetation removal or construction <br />commences during the general avian nesting season (March 1 through <br />July 31), a pre -construction survey for all species of nesting birds is <br />recommended. If active nests are found, work in the vicinity of the nests <br />should be delayed until the young fledge. <br />• The site is not within designated critical habitat for any federally listed <br />species. <br />We hope this information is useful.
