In the event 7-H changes its Contract Manager, CITY has the right to review and <br />approve the proposed replacement. Such approval shall not be unreasonably <br />withheld. <br />3.2 Process Control. 7-H will provide on-call backup process control <br />management personnel from its Regional Office in Grass Valley, California. <br />3.3 Training and Safety. 7-H will maintain an education and safety program for <br />7-H employees which provides for all Government mandated safety training. <br />This program is to be patterned after the 7-H program currently utilized. The cost <br />of this program will be the responsibility of 7-H. <br />3.4 Facility Capacity. Both 7-H and CITY agree that the Facility capacity is <br />limited by the capacity of the Spray Fields Effluent Disposal System. The current <br />Plant capacity is 1.2 mgd with a current average daily flow of 0.90 mgd. The <br />current capacity of the Spray Fields Effluent disposal System is 1.4 mgd. <br />3.5 Scope of Costs. 7-H shall be responsible for the following costs: 1) all <br />personnel costs, 2) process chemicals, 3) fuels and lubrications, 4) consumable <br />operating supplies, 5) all vehicle costs, 6) maintenance repair and replacement of <br />all equipment in accordance with paragraph 3.6 of this agreement, 7) training and <br />certification of 7-H personnel, 8) hand tools, 9) preventative and corrective <br />maintenance of plant and disposal field equipment in accordance with paragraph <br />3.6 of the agreement, 10) laboratory analyses of process and effluent quality per <br />current Regional Water Quality Control Board Order No. monthly <br />reports of operational and performance to regulatory agencies. <br />3.5 1 Electric Utilities. Both 7-H and the CITY agree that the CITY shall pay for <br />all electrical power for the Wastewater Treatment Plant. 7-H shall operate the <br />Wastewater Treatment Plant to function with a minimum power consumption of <br />42,000-kilowatt hours per month and a maximum power consumption of 50,000- <br />kilowatt hours per month. Should special circumstances arise that require more <br />power consumption than 50,000 kilowatt hours per month, 7-H shall request <br />written approval from the CITY to utilize additional power. Should the CITY deny <br />such request, 7-H shall not be responsible for any failure to meet the <br />requirements set forth in the Regional Water Quality Control Board Order No. <br />3.6 Maintenance. For purposes of this agreement the following definitions shall <br />apply: <br />"Preventative Maintenance" Periodic scheduled maintenance in accordance with <br />industry standards. <br />7-H Teclinical Services Group Contract for Operation and Maintenance Services Page 3 of 12
