(30) days written notice, terminate the agreement without further liability except for <br />payment for services actually rendered by 7-H pursuant to this Agreement prior to <br />termination. <br />2.4 Return of Facilities to CITY Control. At the end of the Agreement Term (whether the <br />full term or something less due to early termination with or without cause) the <br />Facilities (as described in ATTACHMENT "A") shall be turned over to CITY by 7-H in <br />good condition, normal wear and tear excepted. If, during the term of this <br />Agreement, 7-H has failed to maintain and repair the Facilities to the extent it has an <br />obligation to do so under this Agreement, or has failed to clean the Sewer Collection <br />System to the extent of its contractual obligations to do so, 7-H shall protect and <br />indemnify the CITY for and against any expenses reasonably incurred by CITY in <br />bringing the Facilities up to the condition required of 7-H under this agreement. In <br />so agreeing, both parties fully understand that 7-H's responsibilities in this regard <br />are limited under paragraph 3.6 of this agreement. When this AGREEMENT ends <br />and 7-H returns the operation and maintenance of the FACILITY back to the CITY <br />(whether at the end of the full term or subsequent renewals pursuant to paragraph <br />2.2 or earlier due to early termination with or without cause pursuant to section 2.3), <br />7-H shall provide on-site training of CITY Personal for a maximum of sixty (60) days, <br />or a lesser period as determined by the CITY, 7-H shall be compensated for any <br />such on-site training which is beyond the term of Agreement at a rate of per <br />hour per instructor. <br />3. SCOPE OF SERVICES <br />3.1 Staffing 7-H will staff Facility with competent employees qualified in wastewater <br />and sewer collection. 7-H will staff FACILITY seven (7) days per week, sixteen (16) <br />hours per day during the irrigation season of April 15t through October 31st, of each <br />year, and, five (5) days per week, eight (8) hours per day during the period <br />November 1st through March 315t of each year, with routine inspections completed <br />during weekends and holidays. At all times 7-H shall provide staffing necessary to <br />operate the irrigation system in compliance with the State Water Quality Control <br />Board Order No . The Staffing Proficiency, shall, at a minimum, consist of <br />the following levels of Operator Certification and hourly input; <br />Personal Certification Status <br />Chief Plant Operator Grade ll Full Time, 2080 hrs/yr. <br />Operator I Grade I Full Time, 2080 <br />Operator II Grade I, OIT Full Time, 2080 his/yr. <br />Sewer Maintenance Grade I (SM) Full Time, 2080 hrs/yr <br />Contract Manager Grade V 8 hrs/mo <br />7-H Technical Services Group Contract for Operation and Maintenance Services Page 2 of 12
