OBSERVATION: Generator copies of Uniform Hazardous Waste Manifests(UHWM)006453999GBF, dated 2-10-20 and 006567827GBF, dated 10-21-20 were not sent to the California Department of Toxic Substances Control (DTSC)within 30 days of hazardous waste shipment. Mike Belmont stated that the facility does not mail a copy of the manifests to DTSC. REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed UHWM to DTSC by mail.The only exception is when an UHWM starts and finishes as an electronic manifest in the e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a legible copy of each manifest used.The mailing address is: DTSC Generator Manifests, Department of Toxic Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. CORRECTIVE ACTION: Ensure that copies of all generator signed UHWMs are sent to DTSC within 30 days of shipping the hazardous waste. Provide a corrective action statement to the San Joaquin County Environmental Health Department(EHD). This is a Class II violation. 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION: Designated facility signed and dated copies of Uniform Hazardous Waste Manifests (UHWM) were not found on-site. The missing manifest is: 006453999GBF, dated 2-10-20. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest to the California Department of Toxic Substances Control (DTSC)within 60 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: Locate the destination facility signed manifests listed above and maintain in the facility file for three years from the date of shipping. Send a copy to the San Joaquin County Environmental Health Department(EHD). This is a Class II violation.
