Weekend. It has been claimed that because our permits were issued for this year, and we passed <br />inspection last year, that there is no problem. My concern is the liability to all homeowners if an accident <br />were to happen and our insurance would not cover the claim because we do not comply with all the <br />relevant Pool Codes. While it appears your department does work with pool operators in giving time to <br />make corrections, there are some safety violations that involve direct physical safety risks that have not <br />been addressed. If there was a claim directly related to the lack of compliance with a specific Pool Code, <br />such as the lack of a buoy divider system, resulting in death or injury, everyone involved could be liable. <br />I have to question the current inspection system. I have reviewed the last four years Inspection Reports. <br />What I discovered is the lack of follow-up to check if violations were corrected, including writing the <br />violation two years in a row. Also there was a failure to note some major safety violations. I bring this up <br />because our insurance company can decline to honor claims if we do not meet all codes. As you know, <br />pools can be a very large liability, especially if an incident occurs because we did not comply with all pool <br />requirements. <br />I found the following after reviewing the previous four years of Inspection Reports. There might be similar <br />issues going back further. That violations were not addressed after your department gave specific <br />timetables for correction, and then written up again in subsequent years, is troubling. <br />2015 Inspection Report, Pool 1: <br />1. No pool capacity written on sign. <br />2. Facility name and address not written on signage. <br />3. Pool entrance does not have a "Keep Gate Closed sign. <br />4. Float valve assembly in skimmer has broken valve. <br />5. No effluent gauge. <br />2016 Inspection Report, Pool 1: <br />1. Skimmer lacks a float valve assembly. <br />2. Wooden concrete divider sticking up creating trip hazard. <br />3. No effluent gauge. <br />2017 Inspection Report, Pool 1: <br />1. Pool entrance does not have a "Keep Gate Closed sign. <br />2. Flow meter is stuck. <br />2018 Pool Inspection Report, Pool 1: <br />1. Pool capacity and pool hours missing (see 2015 Report). <br />2. Loose handrail. <br />3. Daily records not updated. <br />4. Flow meter stuck (see 2017 Report). <br />5. No effluent gauge (see 2015 and 2016 Reports). <br />2015 Inspection Report, Pool 2: <br />1. Pool capacity sign needs to be filled (subsequently filled in with wrong number) <br />2. Needs address on emergency sign (no such address). <br />3. No "Keep Closed" sign outside gate. <br />4. No effluent gauge. <br />2016 Inspection Report, Pool 2: <br />1. North end weir skimmer lack weir door. <br />2. No effluent gauges (see 2015 Report). <br />3. Loose railings at shallow end. <br />4. Needs address on emergency sign (no such address)(see 2015 Report). <br />2017 Inspection Report, Pool 2: <br />1. No "Keep Closed" sign outside gate. <br />2. Weir skimmer lacks a float. <br />3. Weir skimmer lacking a plug. <br />2018 Inspection Report, Pool 2: <br />1. No "Keep Closed" sign outside gate (see 2015 Report). <br />2. Safety signs faded and need to be replaced within 2 weeks (not done as of April, 2019). <br />3. Loose handrails at shallow end (see 2016 Report). <br />4. Skimmer assembly with no flappers. <br />5. No effluent gauges (see 2015 and 2016 Reports). <br />
