(26) Approximately 136,035 people live within 4 miles of the site (45). 4.0 EMERGENCY RESPONSE CONSIDERATIONS The National Contingency Plan [40 CFR 300.415 (b) (2)] authorizes the EPA to consider emergency response actions at those sites that pose an imminent threat to human health or the environment. For the following reasons, a referral to Region TX's Emergency Response Section does not appear to be necessary: No residents live on site. The size of the site is approximately 47 acres. The site has been entirely fenced and locked during non- working hours since 1925, and has been paved in and around where hazardous substances are being used and stored. There are nine waste collection points throughout the site and one hazardous substance and one hazardous waste storage area along the southern property boundary of the site. To the north is the McCormick and Baxter Creosoting Company, an Environmental Protection Agency National Priorities List site. Groundwater sampling from monitoring wells on the McCormick and Baxter Creosoting Company site indicate the presence of hazardous substances related to the wood treating industry. The contaminant plume from the McCormick and Baxter site is migrating to the east and southeast. Therefore, contamination may cross the northeast corner of the Cal Cedar site. Five agencies have had regulatory involvement with the California Cedar Products Company site. The California Environmental Protection Agency, Department of Toxic Substances Control (formerly known as the Department of Health Services, Toxic Substance Control Division) granted a one-trip variance for the removal of 5 gallons of asbestos fiber in 1985. No complaints have been registered; therefore, there is no current agency involvement with the site. The Regional Water Quality Control Board, Central Valley Region, Underground Storage Tank Department, has a record of five underground gasoline storage tanks that were removed from the site.
