Marlowe owns property at <br />4630 - 4698 East Waterloo Road just outside Stockton, California. <br />Marlowe has been remediating the effects of a leaking underground storage <br />tank on the above-referenced property the last few years. In connection with that <br />remediation, chlorinated hydrocarbon contamination in the groundwater was <br />discovered beneath the site. Subsequent sampling from surrounding properties <br />showed that they too were contaminated with chlorinated hydrocarbons, <br />specifically, methylene chloride, TCE and DCE, as well as others. <br />The San Joaquin County Public Health Services-Environmental Health Divi- <br />sion ("PHS/EHD") has directed Marlowe to take various steps to further investigate <br />the contamination and recently invited the federal Environmental Protection <br />Agency to inspect the site. A copy of the PHS/EHD's chronology is attached for your <br />review, along with recent communications from the EPA. <br />PHS/EHD's focus on Marlowe has been to the exclusion of other potential <br />causes of the contamination. Since PHS/EHD does not know the source of the <br />pollutants there is no assurance that on-going contamination is not occurring. Its 0 0- failure to more broadly investigate other potential sources does not protect public <br />health. In January of last year, one of Marlowe's tenants filed a personal injury suit <br />naming Marlowe and alleging that the contamination had caused him various <br />ailments. A copy of the complaint is also attached for your review. At the tenant's <br />prodding, the PHS/EHD sampled a few of Marlowe's septic tanks.
