San Joaquin County Environmental Checklist <br /> Setting <br /> Regulatory Setting <br /> A variety of agencies have jurisdiction over the NCRC&SL. Water quality <br /> regulations applicable to the project are outlined below. <br /> Federal Regulations <br /> Clean Water Act <br /> Important applicable sections of the CWA (33 USC 1251-1376)are listed below. <br /> ■ Sections 303 and 304 provide water quality standards,criteria,and <br /> guidelines. <br /> ■ Section 401 requires an applicant for any federal permit that <br /> proposes an activity that may result in a discharge to waters of the <br /> United States to obtain certification from the state that the discharge <br /> will comply with other provisions of the CWA. Certification is <br /> provided by the RWQCBs. <br /> ■ Section 402 establishes the NPDES,a permitting system for the <br /> discharge of any pollutant(except for dredged or fill material)into <br /> waters of the United States. This permit program is administered by <br /> the RWQCBs. <br /> ■ Section 404 establishes a permit program for the discharge of <br /> dredged or fill material into waters of the United States. This permit <br /> program is administered by USACE. <br /> Federal Flood Insurance Program <br /> Congress,alarmed by increasing costs of disaster relief, passed the National <br /> Flood Insurance Act of 1968 and the Flood Disaster Protection Act of 1973. The <br /> intent of these acts is to reduce the need for large publicly funded flood control <br /> structures and disaster relief by restricting development on floodplains. <br /> The Federal Emergency Management Agency(FEMA)administers the National <br /> Flood Insurance Program(NFIP)to provide subsidized flood insurance to <br /> communities that comply with FEMA regulations,limiting development in <br /> floodplains. FEMA issues Flood Insurance Rate Maps(FIRM)for communities <br /> participating in the NFIP.
