4. All required onsite and offsite easements and dedications shall be offered to the MHCSD through <br /> offers of dedication to the MHCSD or shall be recorded on the Final Map. Dedication of public rights- <br /> of-way shall be in conformance with the adopted Public Land Equity Program (PLEP).Any easements <br /> to be abandoned that belong to an irrigation district shall not be abandoned without prior approval of <br /> that district. <br /> 5. All costs incurred by the MHCSD for any applicant development project shall be paid by the applicant <br /> in accordance with the MHCSD Development Project Fees for Services Agreement, dated October 9, <br /> 2009, between MHCSD and Shea Mountain House LLC. <br /> 6. Except where provided otherwise in a Project Acquisition Agreement or Project Reimbursement <br /> Agreement, prior to the recording of any Final Map, all infrastructure facilities outside the boundary of <br /> the Tentative Map (water, sewer, storm drainage, electric power, natural gas, telephone, <br /> communications, etc.) necessary to serve Neighborhood "K" or "L" shall be in place and fully <br /> operational.Any deferral will require the developer to provide the MHCSD a bond insuring the eventual <br /> construction of the facility. <br /> 7. All conditions on the "Will Serve Letter" from the MHCSD shall be met prior to approval of Final Map, <br /> unless specified otherwise in the letter. The MHCSD General Manager may defer the installation of a <br /> facility if bonding is provided and it can be demonstrated to the satisfaction of the MHCSD Public <br /> Works Director that it is not needed at that time. <br /> 8. All reference to approvals herein by the MHCSD shall be interpreted as approval by the General <br /> Manager or his or her designee, except for those approvals specifically delegated by law to the Board <br /> of Directors. <br /> 9. All references to bonding shall mean a bond or any other security acceptable to MHCSD in compliance <br /> with the State of California Subdivision Map Act and provided by a company doing business in <br /> California. <br /> 10. All conditions of approval and all applicable impacts and mitigation measures identified in SP II plan <br /> and SP II Initial Study are to be completed as directed in the Mitigation Monitoring report, unless <br /> specifically addressed otherwise in one of the conditions of approval for the Tentative Map. <br /> 11. All public lands shown on the Tentative Map shall be dedicated or offered for dedication to MHCSD <br /> at the time of approval of the Final Map in accordance with the PLEP Ordinance, if applicable. <br /> 12. Final Maps shall conform to the roadway system depicted in Specific Plan II, Figure 9.1 for arterials <br /> and collectors, conforming to the latest MHCSD Standard Specifications and Standard Plans, to the <br /> Bicycle and Pedestrian systems as shown in Specific Plan II, Figure 9.2, and to the transit system <br /> depicted in Specific Plan Il, Figure 9.3,to the extent that such standards do not conflict with the MARA. <br /> Transit Stops shall be designed into Improvement Plans unless waived by the Public Works Director. <br /> 13. All street standards shall comply with the State of California Fire Code provisions, as interpreted and <br /> implemented by the San Joaquin County Fire Marshall and City of Tracy Fire Department. <br /> 14. All water rights shall be dedicated to the MHCSD upon approval of Final Maps. <br /> 15. Whenever all or any portion of a local or an arterial street is constructed, the improvements shall <br /> include the installation of all streetlights. The Neighborhood lighting shall be provided as required by <br /> the MHCSD Design Manual and as directed by the Public Works Director. Street lights shall also <br /> conform to the MHCSD Technical Specifications and Design Standards in effect at the time of the <br /> submittal for final approval. <br /> 16. Restricted access shall be shown on the Final Map and shall be in accordance with the Master Plan, <br /> the Design Manual, the MHCSD's Specifications and as directed by the MHCSD. <br /> PA-1000266—Conditions of Approval 10 <br />
