Three red 5-gallon buckets storing used oil <br /> 3.A blue 5-gallon bucket storing used oil <br /> 4. Two 55-gallon drums of used paper filters <br /> Five containers of damaged leaky auto retail chemicals, including a 5-quart container of motor oil,were observed in <br /> plastic bags on a shelf in the retail area back room.Terry Reed, Retail Manager, corrected the issue by placing the <br /> leaky chemical containers into the retail hazardous waste containers at the time of inspection. <br /> REGULATION GUIDANCE:A container holding hazardous waste shall always be closed during transfer and <br /> storage, except when it is necessary to add or remove waste. <br /> CORRECTIVE ACTION: Immediately close these containers and ensure all hazardous waste containers are closed <br /> when not adding or removing waste. Provide a corrective action statement and supporting documentation to the <br /> San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 601 CCR 66262.34(a)Stored hazardous waste on site longer than 90 days without a permit or authorization. <br /> OBSERVATION: The following hazardous waste container was found on-site with an accumulation start date of <br /> greater than 90 days: a hazardous waste container storing flammable carburetor cleaner aerosol cans located in the <br /> service area was observed with an accumulation start date of 1/27/2021. <br /> REGULATION GUIDANCE: <br /> (a)a generator may accumulate hazardous waste on-site for 90 days or less <br /> (b)The beginning of the 90 day period is determined as follows: <br /> (1)if the generator does not generate more than 100 kilograms of hazardous waste or one kilogram of acutely <br /> hazardous waste(listed in section 66261.33(e))or one kilogram of extremely hazardous waste during any calendar <br /> month, the 90 day period begins on the date the generator has accumulated 100 kilograms of hazardous waste or <br /> one kilogram of acutely hazardous waste or one kilogram of extremely hazardous waste; <br /> (2)if the generator generates more than 100 kilograms of hazardous waste or one kilogram of acutely hazardous <br /> waste or one kilogram of extremely hazardous waste during any calendar month,the 90-day period begins on the <br /> first date on which any amount of hazardous waste begins to accumulate during that month. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 90 days in <br /> compliance with Title 22 California Code of Regulations.
