FINDINGS FOR USE PERMIT <br /> PA -2100126 ( UP ) <br /> DARREN MANGRUM <br /> 1 . Consistency <br /> The proposed use is consistent with the goals , policies , standards , and maps of the General Plan , any <br /> applicable Master Plan , Specific Plan , Special Purpose Plan , and Planned Development zone ; and any <br /> other applicable plan adopted by the County . <br /> • This finding can be made because the use type " Commercial Cannabis — Cultivation " may <br /> be conditionally permitted in the AG -40 ( General Agriculture , 40 -acre minimum ) zone with <br /> an approved Use Permit and accompanying Commercial Cannabis Development <br /> Agreement . The project site has a General Plan designation of AIG ( General Agriculture ) , <br /> and the AG40 zone is an implementing zone for this designation . There are no Master Plans , <br /> Specific Plans , or Special Purpose Plans in the vicinity . <br /> 2 . Improvements <br /> Adequate utilities , roadway improvements , sanitation , water supply , drainage , and other necessary <br /> facilities have been provided , and the proposed improvements are properly related to existing and <br /> proposed roadways . <br /> • This finding can be made because adequate utilities , access roads , sanitation , drainage , <br /> and other necessary facilities are proposed and the improvements are properly related to <br /> existing and proposed streets and highways . A storm water drainage retention pond will be <br /> constructed under permit and inspection from the Department of Public Works . The project <br /> will be required to have an onsite well and onsite septic system that is sized for the project <br /> and installed under permit from the Environmental Health Department. Additionally , all <br /> cannabis - related activities will be conducted indoors as required by Development Title <br /> Section 9 -409 . 140 ( b ) ( 3 ) . <br /> Land use requirements require that a Commercial Cannabis cultivation site be no more than <br /> 2 , 000 feet from a major intersection or arterial road unless there is sufficient ease of access <br /> from the proposed parcel to an arterial road . The project location is located 4 , 500 feet south <br /> of a major intersection , more than the 2 , 000 -foot maximum , therefore the County considered <br /> the alternative criteria . The intersection with E . Eleventh Street is a major intersection with <br /> a 4 -way traffic signal . South Bird Road is a straight , paved , County -maintained road for 2 - <br /> way traffic with a speed limit of 55 mph , and with no obstructions to impede traffic . There <br /> are 2 cross -streets along S . Bird Road between the project site and E . Eleventh Street that <br /> are both signed in the east-west direction . <br /> Additionally , the proposed project site access driveways will be a minimum of 20 -feet in <br /> width to meet the fire road standards and the gates entrance will have a Knox box that can <br /> be accessed by emergency responders . <br /> 3 . Site Suitability <br /> The site is physically suitable for the type of development and for the intensity of development . <br /> • This finding can be made because the 3 -acre parcel is of adequate size and shape to <br /> accommodate the proposed use and structures , as well as yards , building coverage , <br /> setbacks , parking areas and other requirements of the Development Title . The facility will <br /> generate very little traffic and all activities must be conducted indoors ; therefore , the intensity <br /> of the development will be of minimal and physically well -suited to the location . <br />
