1 3 . 2 The Respondent violated HSC § 25507 , failed to establish and <br /> 2 implement a hazardous materials business plan <br /> 3 3 . 3 The Respondent violated HSC § 25508 ( a ) ( 1 ) , failed to complete <br /> 4 and /or submit the Business Activities or Owner/Operator Identification <br /> 5 page <br /> 6 3 . 4 The Respondent violated HSC § 25505 ( a ) ( 1 ) , failed to complete <br /> 7 and /or submit hazardous materials inventory for all reportable <br /> 8 materials on site <br /> 9 3 . 5 The Respondent violated HSC § 25505 (a ) ( 2 ) , failed to complete <br /> 10 and /or submit a site map with all required content <br /> 11 3 . 6 The Respondent violated HSC § 25505 ( a ) ( 3 ) , failed to establish <br /> 12 and /or submit emergency response procedures for a release or <br /> 13 threatened release <br /> 14 3 . 7 The Respondent violated HSC § 25505 ( c) , failed to have the business <br /> 15 plan readily available to facility or EHD personnel <br /> 16 4 , The Parties wish to avoid the expense of litigation and to ensure prompt <br /> 17 compliance with California requirements regarding hazardous materials . <br /> 18 5 . Jurisdiction over this matter exists pursuant to HSC § 25404 . 1 . 1 . <br /> 19 6 . Respondent waives any right to a hearing in this matter . <br /> 20 7 . This Consent Order shall constitute full settlement of all violations of <br /> 21 Chapter 6 . 95 of the California Health and Safety Code pertaining to the Site <br /> 22 and arising before the Effective Date of this Consent Order , This Consent <br /> 23 Order does not limit the CUPA from taking appropriate enforcement action <br /> 24 concerning any other violations . <br /> 25 8 .
