According to the <br /> maintenance employee interviewed on-site, the transport truck will contain up to 100 gallons of used oil, at any one <br /> time. The tank capacity is 150 gallons. The used oil is hauled to a George Reed facility at 5693 O'Byrnes Ferry <br /> Road, Jamestown, CA without using a consolidated manifest receipt or a uniform hazardous waste manifest. The <br /> used oil is sent to a recyclers from the Jamestown address. California Health and Safety Code section 25250.12 <br /> only allows transport of a maximum of 55 gallons of used oil without a hazardous waste manifest. <br /> REGULATION GUIDANCE: <br /> California Health and Safety Code section 25250.12. <br /> Used oil generated during maintenance operations may be transferred from its point of generation to the <br /> maintenance person's place of business, other than a residence,for the purpose of consolidation in a tank or <br /> container,without meeting the requirements of Sections 25160, 25163, and 25201, if the material is to be recycled <br /> at an authorized offsite hazardous waste facility and if all the following conditions are met: <br /> (a) The generator transports the used oil in a vehicle owned by the generator or owned by an employee of the <br /> generator. <br /> (b) Not more than 55 gallons are transferred in the vehicle at any one time. <br /> (c) The used oil is managed in accordance with all laws concerning storage and handling of hazardous wastes <br /> upon consolidation at the maintenance person's place of business. <br /> (d) The used oil is deemed to be generated at the point of consolidation upon consolidation. <br /> CORRECTIVE ACTION: Provide a corrective action statement to the San Joaquin County Environmental Health <br /> Department(EHD)within 30 days. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by 10/21/2021 . <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign.
