SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />§9.7 FAILURE OF PAYMENT, REVISE as follows: In the first sentence remove the words "within <br />seven days" and substitute the words "within a reasonable time", delete the words "or <br />awarded by binding dispute resolution" and delete the word "additional" in the following, "the <br />Contractor may, upon seven additional days". <br />§9.8 SUBSTANTIAL COMPLETION <br />§9.8.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§9.8.1 For the purpose of determining Substantial Completion if applicable to, or necessary <br />under this contract, Substantial Completion shall be defined as the stage in the progress <br />of the work when the work or designated portion thereof is sufficiently complete in <br />accordance with the Contract Documents so that the Architect can certify that the work is <br />substantially complete, and so that Owner can safely occupy or utilize the work for its <br />intended purpose and include the minimum requirements as stated in (a) below. <br />When the Contractor considers that the work or a portion thereof, which the Owner <br />agrees to accept separately, is substantially complete, the Contractor shall prepare for <br />himself and his subcontractors a list of items known to be incomplete or which require <br />correction and shall include a similar list as comprised by the Project Inspector for <br />submission to the Architect. Failure to include an item on such list does not alter the <br />Contractor's responsibility to complete all work in accordance with the Contract <br />Documents. <br />The Contractor shall proceed promptly to complete and correct items on the list and <br />when complete, the Contractor shall submit to the Architect a copy of the list indicating <br />his verification that all work is complete as confirmed by the Project Inspector. Upon <br />receipt of the Contractor's list, the Architect will make an observation to determine <br />whether the work or designated portion thereof is substantially complete. <br />When the work or designated portion thereof is substantially complete, the Architect will <br />prepare, in conjunction with the Contractor's and the Project Inspector's list, a <br />comprehensive list (sometimes referred to as the Punch List) of items remaining to be <br />completed or corrected and a letter indicating his recommendation for acceptance. The <br />Architect's letter shall establish the date of substantial completion, and shall fix the time, <br />which shall not exceed thirty-five (35) days and in agreement with contract closeout <br />requirements established in Specification, Section 01700 (if included within the Project <br />Manual), unless upon the Owner's written agreement to extend the period for a specific <br />purpose, such as arrival of equipment included with the contract, from the date of <br />substantial completion, within which the Contractor shall finish all items remaining on the <br />punch list accompanying the Architect's letter of recommendation. <br />The Owner shall retain sufficient funds to compensate for unfinished items identified on <br />"punch list", and funds encumbered by filed stop notices. <br />.1 Substantial Completion at a minimum shall require the following: <br />.a Access to and egress from is safe and the building(s) is/are secure. <br />9.1 <br />
