SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />The Contractor shall be the beneficial owner of any securities substituted for moneys <br />withheld and shall receive any interest thereon. <br />The escrow agreement used shall be substantially similar to the form presented in <br />Section 22300 of the Public Contract Code. <br />§9.4 CERTIFICATES FOR PAYMENT <br />§9.4.1 REMOVE in the first sentence the words "within seven days" and INSERT in place the <br />words, "within a reasonable period". <br />ADD the following paragraph: <br />§9.4.3 If during the course of construction the Architect determines that the application for <br />payment does not reflect the work completed to date, adjustment may be made to the <br />subsequent application for payment to reflect the actual construction progress. <br />§9.5 DECISION TO WITHHOLD CERTIFICATION <br />§9.5.1 ADD the following subparagraphs: <br />8 Contractor's failure to comply with any lawful or proper direction concerning the <br />work given by Owner or any Owner's representative authorized to have given <br />such instruction. <br />9 Failure to satisfy claims and /or penalties which state law assesses against <br />Contractor for violation of such law. <br />10 Any claim or penalty asserted by or against the Owner by virtue of contractor's <br />failure to comply with the provisions of all governing laws, ordinances, <br />regulations, rules and orders. <br />11 Failure to meet the scheduled miles stones or failing to achieve goals as <br />established within the contract or the scope of work. <br />12 Contractor's failure to provide the Owner with the following items in acceptable <br />form: "record documents" updates, Construction Schedule updates, certified <br />payroll records, and completed lien waiver and release forms. <br />§9.5.2 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§9.5.2 When the above reasons for withholding certification are removed and the Contractor <br />has submitted a revised, accurate application for payment acceptable to the Architect, <br />the Architect shall provide certification of the revised and acceptable application for <br />payment. <br />§9.5.3 DELETE the following words at the end of the last sentence, "and the Architect will reflect <br />such payment on the next Certificate for Payment". <br />25 <br />
