SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />be subject to Owner's approval and in conformance with the Owner's subsequent <br />direction. <br />.5 Machinery and equipment shall be guarded and other hazards shall be <br />eliminated in accordance with the safety provisions of the Construction Safety <br />Orders issued by the Industrial Accident Commission of the State of California. <br />6 All materials brought to the site shall be safely stored in an orderly manner and in <br />areas designated for such storage and in agreement with the Owner's use of the <br />project site and not in conflict with areas where work is proceeding. <br />.a The Contractor shall be solely responsible for any loss, damages or injury <br />resulting from stored materials including overloading of structures, <br />damages to systems or finishes or failure to safeguard materials from <br />exposure, or use prior to Owner acceptance. <br />b The Contractor shall not use the project site for storage of any materials <br />or equipment not to be promptly incorporated in the construction or for <br />immediate construction of the project. <br />§10.2.3 ADD the following subparagraph: <br />§10.2.3.1 Protection of workers in trenches: As required by Section 6705 of the California Labor <br />Code, and in addition thereto, whenever work under the Contract involves the <br />excavation of any trench or trenches 5 feet or more in depth, Contractor shall submit for <br />acceptance by the Owner or by a registered civil or structural engineer, employed by the <br />Owner, to whom authority to accept has been delegated in advance of excavation, a <br />detailed plan showing the design of shoring, bracing, sloping, or other provisions to be <br />made for worker protection from the hazard of caving ground during the excavation, or <br />such trench or trenches. If such plan varies from the shoring system standards <br />established by the Contraction Safety Orders of the Division of Industrial Safety, the plan <br />shall be prepared by a registered civil or structural engineer employed by the Contractor, <br />and all costs therefore shall be included in the price named in the Contract for <br />completion of the work as set forth in the Contract Documents. Nothing in this section <br />shall be deemed to allow the use of a shoring, sloping, or other protective system less <br />effective than that required by the Construction Safety Orders. Nothing in this section <br />shall be construed to impose tort liability on the Owner, the Engineer, nor any of their <br />officers, agents, representatives, or employees. <br />§10.3 HAZARDOUS MATERIALS <br />§10.3.1 ADD the following subparagraph: <br />§10.3.1.1. No asbestos or products containing asbestos have been knowingly specified for this <br />project. Notify the Owner and Architect immediately if materials containing asbestos are <br />brought to the site for inclusion in the Work. <br />ARTICLE 11 INSURANCE AND BONDS <br />ME <br />
