SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />§11.1 CONTRACTOR'S LIABILITY INSURANCE <br />§11.1.1 ADD the following to paragraph: <br />The Contractor shall maintain such insurance as will protect him from claims under <br />Workman's Compensation Acts. <br />Contractor shall maintain policies of public liability bodily injury insurance in an amount <br />not less than One Million Dollars ($1,000,000) for injury or death to any one person and <br />not less than One Million Dollars ($1,000,000) for injury or death to more than one <br />person arising directly or indirectly out of any activity, performance, or operation under <br />the Contract. <br />[EDIT: FCUSD ONLY -- Modernizations Only -- Substitute this Paragraph] <br />Contractor shall maintain policies of public liability insurance in an amount not less than <br />Two Million Dollars ($2,000,000) for injury or death to any one person or for damage to <br />the property of any one person or entity, and not less than Two Million Dollars <br />($2,000,000) for injury or death to more than one person or for damage to the property of <br />more than one person or more than one entity, arising directly or indirectly out of any <br />activity, performance or operation under the Contract. <br />[ALL] <br />The hereinabove mentioned policies shall include Owner, Inspector, Architect, and their <br />officers and employees as additional insureds added by the way of an endorsement to <br />the policy and the coverage of said policies shall be expressly made primary insurance <br />with respect to any other similar coverage carried by the Owner. Copies of such policies <br />or certificates evidencing such policies shall be first approved by the Owner and filed <br />with the Board of Trustees of the Owner. Said policies of public liability and property <br />liability insurance shall contain a contractual liability endorsement recognizing the <br />contractual obligation of Contractor to Owner contained in this paragraph. Contractor <br />shall maintain automobile liability insurance covering owned, hired, and non -owned <br />automobiles with minimum liability, per occurrence, of $1,000,000 for bodily injury and <br />property damage. All policies shall contain a provision requiring thirty (30) days written <br />notice to be given to Owner prior to cancellation, modification, or reduction of limits. <br />Policies shall be reviewed by Owner prior to start of construction. <br />§11.1.3 ADD the following to paragraph: <br />All policies and certificates of insurance of the Contractor shall contain the following <br />clauses: <br />1 Insurers shall have no right of recovery or subrogation against the Owner <br />(including its agents and agencies as aforesaid), it being the intention of the <br />parties that the insurance policies so effected shall protect both parties and be <br />the primary coverage for any and all losses covered by the above-described <br />insurance. <br />.2 The clause "other insurance provisions" in a policy in which the Owner is named <br />as an insured, shall not apply to the Owner. <br />a <br />
