SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />amended copy of Title 24, Parts 1 through 7 and Part 9 shall be kept on the site at all <br />times during the construction. The Contractor shall be knowledgeable of and comply <br />with applicable portions of the California Code of Regulations, Titles 19 and 24 and other <br />codes ordinances, regulations or orders of public authorities having jurisdiction over the <br />project. Contractor shall examine the Contract Documents for compliance with these <br />codes and regulations, and shall notify the Owner, and Architect of any discrepancies. <br />Changes in the Contract Documents shall be made by means of written directions <br />approved by the Owner, Architect and DSA. Change order procedures shall be as <br />described elsewhere within the Contract Documents. <br />§13.8.2 No deviations from the approved contract documents, effecting structure, life safety or <br />revisions to accessibility requirements shall be permitted except upon, a Change Order, <br />signed by the Owner and Architect and approved by DSA. Contractor shall keep an <br />approved set of the approved documents, free of defect, current with postings of the <br />Architect's Construction Change Documents (CCDs) along with responses to Request <br />for Information (RFIs) at the site at all times. <br />§13.8.3 Addenda issued prior to receipt of bids shall be issued by the Architect to plan holders of <br />record only. Addenda shall be signed by the Architect and approved by DSA. <br />ARTICLE 14 TERMINATION OR SUSPENSION OF THE CONTRACT <br />§14.1 TERMINATION BY THE CONTRACTOR <br />§14.1.1 DELETE subparagraphs .3 and .4 <br />§14.2 TERMINATION BY THE OWNER FOR CAUSE <br />§14.2.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§14.2.1 If the Contractor refuses or fails to progress the work or any separable part thereof with <br />such diligence that will ensure its completion within the time specified, or any extension <br />thereof, or fails to complete said work within such time, or withholds, or threatens to <br />withhold continued work regardless of the reason for same, or if the Contractor should <br />be adjudged bankrupt or if he/she makes a general assignment for the benefit for his/her <br />creditors, or if he/she shall make an assignment for any other reason without the <br />express written consent of the Owner, or if a receiver should be appointed on account of <br />Contractor's insolvency or if Contractor refuses or fails, except in cases for which an <br />extension of time is provided, to supply enough properly skilled workers or proper <br />material to complete the work at the time specified, or if Contractor fails to make prompt <br />payment to subcontractors or for material or labor, or disregards laws, ordinances, or <br />instructions of Owner, Architect, or if Contractor or any of his/her subcontractors should <br />otherwise violate a provision of the contract, or if Contractor or any of his/hers <br />subcontractors should perform work in a negligent or dangerous manner, or install or <br />construct any portion thereof so that the work does not comply with the Contract <br />Documents, or does not meet generally recognized industry standards for workmanlike <br />quality, Owner may, without prejudice to any other rights or remedy, serve written notice <br />upon Contractor of intention to terminate Contractor's control over the project, terminate <br />Contractor's right to complete the contract or terminate this contract.
