SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />contain the reasons for such intention to terminate, and Contractor shall immediately <br />cease any and all violations of the terms of this contract, ordinances, or laws and shall <br />correct to the Owner's satisfaction, or make satisfactory arrangements to correct to <br />Owner's satisfaction, within seven (7) days, from the date of said notice, any and all <br />deficient conditions. If Contractor, after proper notice, fails to cease and desist or fails to <br />cure deficiencies within the said seven (7) day period, Owner may terminate Contractor's <br />control over the project, terminate Contractor's right to complete the contract or <br />terminate this agreement by written notice to Contractor, said termination shall be <br />effective upon delivery of written notice to Contractor, his/her officers, agents or <br />employees, or notice by certified mail to Contractor's business address. <br />§14.2.2 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />When any of the above reasons exist, the Owner, upon certification by the initial <br />Decision Maker that sufficient cause exists to justify such actions, may without prejudice <br />to any other rights or remedies of the and after giving the Contractor and Contractor's <br />surety, seven (7) days written notice, terminate employment of the Contractor and may, <br />subject to any prior rights of the surety: <br />Exclude the Contractor from the site and in the interest of compensation for <br />project debt and damages, take possession of all materials, equipment, tools, <br />and machinery thereon owned by the Contractor until such time as outstanding <br />debts and damages are satisfied. <br />2 Accept assignment of subcontracts pursuant to Section 5.4 and finish the Work <br />by whatever reasonable method the owner may deem expedient. <br />.3 Upon written request of the Contractor, the Owner shall furnish to the Contractor <br />a detailed accounting of the costs incurred by the Owner in finishing the Work. <br />§14.2.3 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§14.2.3 In the case of termination, Contractor shall not be entitled to receive further payment <br />until the project is complete. In the event of termination, Owner shall immediately serve <br />written notice thereof upon the Surety consistent with the terms and conditions set forth <br />in the performance bond incorporated within these contract documents. Surety shall not <br />be allowed to reappoint or contract with Contractor to complete this project without the <br />express written consent of the Owner. Upon termination, Contractor shall be ejected <br />from the project and Owner may without liability for so doing, take possession of and <br />utilize in completing the work, such materials, appliances, equipment, plant and other <br />property belonging to the Contractor as may be on the site of the work and necessary <br />therefore. <br />§14.2.4 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§14.2.4 If the unpaid balance of the Contract sum exceeds costs of finishing the work, including <br />compensation for Architect's services and expenses made necessary thereby, and other <br />damages incurred by the Owner and not expressly waived, such excess shall be paid to <br />the Contractor.
