SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />1961, as amended, and all rules, regulations and relevant orders of the President's <br />Committee on Equal Employment Opportunity created thereby <br />§3.4.3.2 Alcohol, Drugs and Tobacco <br />It is the policy of the School District that all property owned by the District is to be <br />alcohol, drug and tobacco -free. This policy prohibits the use of alcohol, illegal <br />use of drugs, smoking and chewing tobacco on this site or within the boundaries <br />of District property. <br />2 It is the responsibility of the Contractor to supervise all workers on the project to <br />ensure that their conduct is not in violation of this policy and to post notices of <br />this policy in prominent locations on the site. Violators will be required to leave <br />the site. Multiple offences will result in the individual being permanently <br />prohibited from returning. <br />§3.4.3.3 Fingerprint Requirements <br />Contractor Fingerprint Requirement Notification: Department of Justice Clearance <br />(Education Code 45125. 1), Assembly Bill 1610 and Assembly Bill 2102 amend <br />Education Code Section 45125 to require criminal background checks of the employees <br />of contractors providing services to educational agencies within the State of California. <br />Fingerprinting is required on this project. Special exclusion is made in a case of <br />emergency or exceptional situation relating to pupil health or safety where a student may <br />be endangered or facilities need to be made safe and habitable. <br />The law authorized the School District to require a Contractor to comply with <br />fingerprinting requirements if a determination is made that the contracting employees <br />may have limited contact with pupils. The standard by which "limited contact with pupils" <br />is measured is "the totality of the circumstances, including factors such as the length of <br />time the contractor will be on school grounds, whether pupils will be in proximity with the <br />site where the Contractor will be working, and whether the Contractor will be working by <br />themselves or others." <br />The law allows the Department of Justice to forward one copy of the print to the FBI if it <br />deems it necessary. It has the authority to determine if there are convictions or arrests <br />pending for offenses that, if committed in California, would have been punishable as a <br />violent or serious felony. An entity having a contract as specified in this section and an <br />entity required to comply with this section by the School District with which it has a <br />contract, shall complete the requirements of this section within 10 days of notification of <br />award of bid. <br />The Contractor must complete required Department of Justice forms. The Contractor <br />must certify in writing to the School District that none of its employees who may come in <br />contact with pupils have been convicted of a felony as defined in Section 45122.1 by <br />submitting the Contractor Certification Form included at the end of this Section. The <br />Contractor shall not permit an employee to come in contact with pupils until the DOJ has <br />completed the background check investigation. <br />7 <br />
