SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />damage to any person or property for which Owner is entitled to be indemnified <br />hereunder. <br />2 In any and all claims against the Owner or any of its agents or employees, by any <br />employee of any subcontractor, anyone directly or indirectly employed by any of <br />them, or anyone for those acts any of them may be liable, the indemnification <br />obligation shall not be limited in any way by any limitation on the amount or type <br />of damages, compensation, or benefits payable by or for the Contractor or any <br />sub -contractor under worker's compensation acts, disability benefit acts or other <br />employee benefit acts. Upon demand, the Contractor shall defend any suits or <br />actions arising from such claims. <br />,3 Owner not liable for damages: The Owner, its officers, agents and employees, <br />and its authorized representatives shall not in any way or manner be answerable <br />or suffer loss, damage, expense, or liability for any loss or damage that may <br />happen to said Work, or part thereof, or in or about the same during its <br />construction and before acceptance and the said Contractor shall assume all <br />liabilities of every kind or nature arising from said Work, either by accident, <br />negligence, theft, vandalism, or any cause whatever; and shall hold the Owner, <br />its officers, agents and employees, and its authorized representatives harmless <br />from all liability of every kind and nature arising from accident, negligence, or any <br />cause whatever, other than for the active negligence of the Owner, its officers, <br />agents and employees, and its authorized representatives. <br />.4 Owner not liable for debts: Indebtedness incurred for any cause in connection <br />with this Work must be paid by the Contractor, and the Owner is hereby relieved <br />at all times from any indebtedness or claim other than the Contract price. <br />.5 Contractor responsible for his work: Responsibility for Accident, Damage, etc.: <br />To the furthest extent permitted by law, the Contractor shall be responsible for <br />any and all loss, accident, neglect, injury, or damage to person, life, or property <br />which may be the result of, may be caused by, or arise out of his performance of <br />Work as contemplated by said Specifications or the execution of the Contract for <br />performance of said Work, and for which the Owner might be held liable. <br />6 The foregoing indemnity provisions shall not extend to any right to recover <br />attorney fees incurred in any action for breach of contract, and shall imply no <br />reciprocal right to attorney fees under Civil Contract Code section 1717 or <br />1717.5. <br />ARTICLE 4 ARCHITECT <br />§4.1 GENERAL <br />§4.1.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§4.1.1 The Owner has retained Rainforth Grau Architects, 2407 J Street, Suite 202, <br />Sacramento, California 95816-4736 as Architect for this project. The Architect will <br />advise and consult with the Owner and all communication between the Owner and <br />Contractor, unless noted otherwise, shall be issued through the Architect. The Architect <br />is responsible for the overall design of the project and is the final authority, in <br />consultation with the Owner, in judgments of aesthetic consideration. The drawings, <br />specifications, sketches and other data necessary to define the work covered by these <br />12 <br />
