SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />§3.13.1 The Contractor shall be responsible for preparing and submitting required documents for <br />obtaining approval by local and state governing jurisdictions and for implementation of <br />an approved Storm Water Pollution Prevention Plan. Plan shall include site <br />winterization, temporary site access ways, place materials such as road base rock and <br />maintain safe access to temporary facilities, parking areas and all areas of work as <br />necessary to continue work without schedule interruption throughout the course of <br />construction and throughout completion of the project. Temporary access ways shall be <br />removed once need is eliminated and no remnant shall remain once removed. <br />§3.13.2 Noise: Contractor shall comply with local noise ordinances as required. <br />At existing school sites or when construction activity extends in the period when school <br />is occupied, the Contractor shall minimize construction noise and disallow radio, music <br />and the like that will disrupt teaching in a classroom. When tests are given in school, the <br />contractor may be asked to re -schedule work to prevent disruption in the classroom. <br />§3.15 CLEANING UP, ADD the following paragraphs: <br />§3.15.3 The Contractor shall protect and preserve the work from all damage resulting from <br />foreseeable or unforeseeable accident, vandalism, weather or other hazards, providing <br />any temporary measures necessary to protect the work in progress. Such protection <br />shall extend to adjoining property of the Owner or of others affected by the Contractor's <br />work. The Contractor shall be responsible for protection of the work until the Notice of <br />Completion is recorded. <br />§3.15.4 The Contractor shall take necessary steps to prevent air -born debris or dust from leaving <br />the site and or affecting the occupation of other buildings on the site. The Contractor <br />shall provide "Dust Control" sufficient to prevent accumulation on adjoining properties <br />and facilities. <br />§3.17 ROYALTIES, PATENTS AND COPYRIGHTS, ADD the following at the end of the last <br />sentence, "immediately upon discovery." <br />§3.18 INDEMNIFICATION: <br />§3.18.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />§3.18.1 Contractor indemnifies Owner: Contractor shall indemnify the Owner, Inspector, <br />Architect and their agents and employees and hold them free, safe, and harmless of, <br />from, and against any and all liability for the death of, or injury to, or loss of use of any <br />property, which may arise by reason of the acts done or omitted to be done as a result of <br />the Work to be done by the Contractor in completion of performance of the said Work <br />contemplated by the said Specifications and the Contract for the performance of said <br />Work, other than for the active negligence of the Owner, its officers, agents and <br />employees. <br />Contractor shall defend or at Owner's sole option reimburse the Owner upon <br />demand for all reasonable cost and expense which the said Owner may incur in <br />resisting any claim which may be made against said Owner for any injury or <br />ii <br />
