SUPPLEMENTARY CONDITIONS <br />Section 00800 <br />15-1207 <br />§5.2.6 Contractor shall not perform work on this project with a subcontractor who is ineligible to <br />perform work on public works projects pursuant to labor Code section 1777.1 or 1777.7. <br />§5.3 SUBCONTRACTUAL RELATIONS, ADD the following paragraphs: <br />§5.3.1 The Owner and Architect will, to the extent possible, initiate communication to the <br />subcontractor through the Contractor, who shall be responsible for the proper execution <br />of the entire work. <br />§5.3.2 When any portion of the Work that has been subcontracted by Contractor is not being <br />performed in satisfactory manner or when materials supplied do not conform to the <br />Contract Documents and these deficiencies form the basis of a default notice issued <br />pursuant to Article 14, the Owner may direct the Contractor to discharge the <br />subcontractor or supplier. <br />Any termination of a subcontractor or supplier pursuant to this section shall be in <br />strict conformity with the requirements of subletting and subcontracting Fair <br />Practice Act, Part 1 Division 2 of the Public Contract Code, commencing with <br />section 4100. <br />.2 A subcontractor or supplier who has been discharged shall not again be <br />employed to perform work under this contract. <br />§5.3.3 Subletting the whole or any part of the Contract shall be done only in accordance with <br />the provisions of Public Contract Code Section 4107, which states that the Contractor <br />shall not, without the consent of the Owner, either: <br />Substitute any person or organization as subcontractors in place of the <br />subcontractors designated in his original bid form. <br />2 Permit any subcontractor to be assigned or transferred or allow it to be <br />performed by any other than the original subcontractor listed in the bid form. <br />3 Sublet or subcontract any portion of the work in excess of one-half (1/2) of one <br />percent (1 %) of his bid as to which his original bid did not designate a <br />subcontractor. <br />Should the Contractor violate any of the provisions of said Public Contract Code Section <br />4107, his so doing shall be deemed a violation of this Contract, and the Owner may (1) <br />cancel the Contract, or (2) assess the Contractor a penalty in the amount of not more <br />than ten percent (10%) of the amount of the subcontract involved, or (3) both cancel the <br />Contract and assess the penalty. <br />ARTICLE 6 CONSTRUCTION BY OWNER OR BY SEPARATE CONTRACTORS <br />§6.1 OWNER'S RIFHT TO PERFORM CONSTRUCTION AND TO AWARD SEPARATE <br />CONTRACTS <br />§6.1.1 DELETE this paragraph in its entirety and SUBSTITUTE the following: <br />14 <br />
