All implementing projects shall comply with the San <br />Joaquin County Multi -Species Habitat Restoration Plan IHCP }, including all <br />required take avoidance and pre -construction survey requirements. <br />Alternattvely, if the SJCM$HCP term mates, applicants within the Specific <br />Flan fl area may proceed with the Implementation of the Mountain House <br />Habitat Management Plan, contained within the Master Specific plan <br />Appendix 7-S, This measure is pursuant to the terms of Section 3.11 of the <br />Master Plan Development Agreement between San Joaquin County and <br />3fimarls osrr osr-ikies, kCthe Master Develoyr. <br />Endangered Species Acts. In carrying out the operations of the project, the <br />applicant shati take no action that violates the provisions of the Califomia <br />Endangered Species Actorthe Federal Endangered Species Act. <br />Cum ptianon vvith said laws shall be the sole resportslbility of the applicant, <br />and the app11rant agrees to indemnify, defend, and hold the County harmless <br />from and against any claim or action by affected State agencies as to the <br />project's compliance with sold laws, <br />Old River Levee. The existing Old Fiver levee shall be preserved andlor <br />enhanced to provide Inalxltat for the western pond turtle, raptors, and ether <br />special- status species, as may he appropriate to this habitat <br />7.3.2 Wetlands <br />Master Plan Summary <br />The Master Plan requires that development be carried out so that existing wedands are <br />preserved to the degree practicable. When lass is unavoidable, it will be Compensated <br />through mitigation. Buildings and structures will beset back from wetlands a minimum of <br />50 feet and protected by fencing or buffers: this setback distance should be Increased <br />where wetlands are of high value_ Passive recreational uses may be permitted adjacent to <br />wetlands, but active recreational uses will not runoff water from the urbanized uses <br />within Meurtain House will not be allowed to enter the Dry Creek wetlands or the adjacent <br />jurisdictional channel. <br />Active and passive recreational uses near wetlands will be addrassed in the full-ICS❑'s <br />Parks, Recre&ion and LeisilMl Plea, as amended. A Wetlands Management flan is <br />required for every Specific Plan area that Includes wetlands. The plan frust include <br />setbacks for structures from wetlands - <br />Plan Description <br />Wetlands occur at several distinct locations within the boundary Of Specific Plan II, <br />including Mountain House Greek, Dry Creek, and a small area north of the wastewater <br />treatment plant_ The previously delineated wetlands within Neighbarhbod C weTe <br />subsequently determined by the Corps to be isolated and therefore non jl�risdlCiianal <br />pursuant to the SWANCC Supreme Court decision. <br />The isolated wetland north of the wastewater treatment plant is approximately 1.4 a ores in <br />area and is bounded by a Wicklund Gut, Old River Regional Park, the wastewater <br />treatment plant, a collector street and a small frontage of medium density+ resWential use. <br />The area will be preserved and includes a 50 -fact buffer from adjacent residential uses.
