BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br />STATE OF CALIFORNIA. <br />RESOLUTION <br />R-22-171 <br />RESOLUTION APPROVING <br />GENERAL PIAN AMENDMENT APPLICATION NO. PA -2200131 <br />WHEREAS, on July 21, 2022, the San Joaquin County Planning Commission considered <br />this matter; and <br />WHEREAS, the Project includes General Plan Amendment No. PA -2200131, Master Ilan <br />Amendment No. PA -2100205, Specific Play lI Amendment No. PA -2100206, Zone <br />Reclassification No. PA -2200132, and Revisions of Approved Actions for Major Subdivision No. <br />PA -0600327; and <br />WHEREAS, the proposed General Plan Amendment (GPA) consists of amendments to the <br />San Joaquin County General Plaza Map, as shown in Attachment A — Exhibit A of the Board of <br />Supervisors Letter, and incorporated by reference herein; and <br />WHEREAS, prior to adoption of the GPA, the Board of Supervisors adopted a Resolution <br />to Adopt the Initial Study and Mitigated Negative Declaration for the Project in accordance with <br />the California Environmental Quality Act (CEQA) (SCH# 2022040227); and <br />WHEREAS, prior to adoption of the GPA, the Board of Supervisors reviewed and <br />considered the information contained in the Initial Study and Mitigated Negative Declaration <br />(SCH# 2022040227) and finds that although the proposed project could have a significant effect <br />on the environment, required mitigation measures will be implemented to reduce these effects to <br />a less than significant level. Mitigation measures are incorporated and included as part of the <br />Conditions of Approval for the project; and <br />WHEREAS, a search of the NACH Sacred Land Nile was requested fpr the Project Area <br />on October 15, 2021. The NAHC responded on November 18, 2021, with a. list of tribal contacts <br />for separate consultation under Senate Bill 18 but did not provide information on Sacred Lands in <br />the Project Area; and <br />WHEREAS, notice of the proposed GPA was provided pursuant to California Government <br />Code Section 65352.3 and 65352.4 (General Plan review by California Native American tribes). <br />Notice was mailed out to California Native American tribes on a list provided by the California <br />Native American Heritage Commission (NAHC) on November 29, 2021. The response period for <br />tribes under SB 18 closed on February 27, 2022; and <br />WHEREAS, on December 16, 2021, Wilton Rancheria responded to request consultation <br />under SB 18.
