2. Funding of MHCSD Development-related Services: All development-related services performed <br /> by the MHCSD not already funded by other applicable MHCSD funding mechanisms, including <br /> special taxes on any development project,will be paid by the Developer at the full cost, including <br /> overhead as determined by the MHCSD General Manager, subject to compliance with all <br /> applicable nexus laws and existing agreements between the MHCSD and Developer. All Costs <br /> incurred by the MHCSD for any development project shall be paid by the Developer in <br /> accordance with the MHCSD Development Project Fees for Deposit and Reimbursement <br /> Agreement with the developer. <br /> 3. All easements and dedications shown on Improvement Plans shall be dedicated to the MHCSD <br /> with the recordation of the final map. <br /> 4. Project shall be in conformance with the adopted Public Land Equity Program (PLEP). Timing: <br /> Prior to final map recordation. <br /> 5. Groundwater Rights: Groundwater rights, should any exist, shall be dedicated to the MHCSD <br /> upon approval of Final Map . <br /> 6. Geotechnical Report: All infrastructure designs shall be shown on the grading and improvement <br /> plans and shall comply with and incorporate the recommendations of the Geotechnical <br /> Engineering Studies. The conditions shall be met before approval of the Improvement Plans. <br /> 7. Environmental Hazards: Comply with all applicable recommendations of the Environmental Site <br /> Assessment prepared for the project. The condition shall be met prior to beginning any <br /> construction on the related improvement plans. <br /> 8. Grading: Except where allowed otherwise by the MHCSD,the grading of the project shall be such <br /> that all stormwater runoff shall drain to public streets, public alleys, Mountain House Creek, Old <br /> River, or drainage facilities within easements for storm-drainage purposes. <br /> 9. Truck Management Plan: Traffic shall comply with the Construction Truck Management Plan <br /> administered by the MHCSD. Project construction plans shall include specifications to the <br /> contractor outlining compliance requirements. A traffic control plan showing construction traffic <br /> routes within the MHCSD's boundary shall be provided for approval by the MHCSD prior to the <br /> commencement of any construction. This plan is required from the Developer, the builders, and <br /> all contractors-and subcontracts working within MHCSD's boundary.The Developer shall pay all <br /> review fees prior to the approval of the plan. <br /> 10. U.S.A. Requirement: U.S.A. shall be contacted 48-hours prior to any lateral crossing of a joint <br /> trench or trenching within the right-of-way. <br /> 11. Hold Harmless Provision: The Developer shall defend, indemnify, and hold harmless the <br /> MHCSD, its agents, officers, and employees, from any claim, action, or proceeding against the <br /> MHCSD, its agents, officers, or employees, to attack, set aside, void, or annul an approval of <br /> MHCSD concerning any MHCSD condition, which action is brought within the time provided for <br /> in Section 66499.37 of the Government Code. <br /> 12. Complete, replace or install any missing or damaged frontage improvements on all sides along <br /> the edges of the development. <br /> 13. All residential buildings shall be wired per the specifications in the MHCSD "Low Voltage <br /> Construction Pre-Wire Guidelines" and other specifications provided by MHCSD prior to <br /> certificate of occupancy. <br /> PA-2100120—Conditions of Approval 6 <br />
