Giuseppe Sanfilippo
San Joaquin County Community Development Department
Re: PA-2100238 (UP): Comments on Draft Initial Study/Mitigated Negative Declaration
May 2, 2023
Page 10
IS-4.3 Water Supply Availability. The County shall consider the
availability of a long-term, reliable potable water supply as a primary
factor in the planning of areas for new growth and development. (Ibid.)
Further, to avoid significant impacts to District operations and irrigation service, the
District requires access to maintain its canal, which is located along the entire north side of
the Project site. If approved, the Project must be conditioned to require a setback of at least
ten feet from the edge of the canal to allow for maintenance and the placement of spoils.
IV. The County is Unable To Make the Findings Required by Section 9-821.6
of its Development Title
Pursuant to Section 9-821.6 of the County Development Title,
Prior to approving an application for a Use Permit, the Review Authority shall find
that all of the following are true:
(a) Consistency. The proposed use is consistent with the goals,policies,
standards, and maps of the General Plan; any applicable Master Plan, Specific
Plan, and Special Purpose Plan; and any other applicable plan adopted by the
County;
(b) Improvements. Adequate utilities, roadway improvements, sanitation, water
supply, drainage, and other necessary facilities have been provided, and the
proposed improvements are properly related to existing and proposed
roadways;
(c) Site Suitability. The site is physically suitable for the type of development and
for the intensity of development.
(d) Issuance Not Detrimental. Issuance of the permit will not be significantly
detrimental to the public health, safety, or welfare or be injurious to the
property or improvements of adjacent properties; and
(e) Compatibility. The use is compatible with adjoining land use.
For the reasons discussed in this letter, the County cannot make the required findings
that the proposed use is consistent with the goals and policies of the General Plan, that
adequate water supply, roadway improvements, sanitation and drainage facilities have been
provided, that the site is suitable for the type and intensity of development, or that the use is
compatible with adjoining agricultural land uses.
