Administrative Draft Environmental Impact Report <br /> Gill Medical Center Project <br /> Mitigation Measures <br /> 4.6-5a: Comply with the San Joaquin County Oak Tree Ordinance. <br /> Site planning and project development shall adhere to the following: <br /> ■ Avoid removal of existing native oak trees to the extent feasible. <br /> ■ If removal of oak trees is required, a certified arborist shall survey the site to identify <br /> Heritage Oak Trees, Historical Trees, and/or Native Oak Trees, as defined by the <br /> Ordinance Code. The arborist report shall be submitted to the County. <br /> ■ The removal of a Native Oak Tree, Heritage Oak Tree, or Historical Tree shall require <br /> an approved Improvement Plan application, as specified in Chapter 9-884 of Title 9- <br /> Development Title, and shall be subject to the provisions of this Chapter, unless <br /> exempted by Sections 9-1505.8 or 9-1505.9 <br /> Timing/Implementation: Prior to tree removal <br /> Monitoring/Enforcement: County of San Joaquin Planning/Development Services Division <br /> Impact 4.6.7 The proposed project could conflict with HCPs, NCCPs, or other conservation plans. <br /> Impact Determination: less than significant <br /> Threshold: Conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br /> Conservation Plan, or other approved local, regional, or state habitat conservation plan, <br /> recovery plan, or federal Biological Opinion. <br /> The Proposed Project is located within the boundaries of and would be subject to the San Joaquin County <br /> Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) (San Joaquin Council of Governments <br /> 2000).As such the Proposed Project would be subject to the following categories of preconstruction <br /> surveys conducted by the Joint Powers Agency(JPA) as outlined in the SJMSCP: <br /> The San Joaquin Council of Governments (SJCOG) shall conduct preconstruction surveys to verify <br /> vegetation types affected by the project and to determine if SJMSCP Covered Species are present <br /> and, if present, attaching Incidental Take Minimization Measures as conditions of project approval <br /> (see SJMSCP Section 5.2.2.5 for survey methodologies).These preconstruction surveys shall be <br /> conducted in the field when a project is located on suitable habitat for one or more of the <br /> SJMSCP Covered Species. <br /> Preconstruction surveys conducted prior to (or, for some Incidental Take Minimization Measures, <br /> during) ground-disturbing activities to determine if SJMSCP Covered Species have been <br /> successfully relocated and/or to determine if other Incidental Take Minimization Measures have <br /> been implemented, as specified in the SJMSCP conditions of approval. <br /> Consistent with the SJMSCP, the Project is required to pay associated impact fees and implement the <br /> above preconstruction surveys to confirm potential impacts to covered species have been appropriately <br /> Biological Resources 4.6-40 October 2021 <br />
