Any turbid water pumped from the work site itself to maintain it in a <br />dewatered state shall be disposed of in an upland location where it will not drain <br />directly into any stream channel. <br />Biological Measures <br />2.22 Special -Status Fish and Wildlife Surveys. Within 48 hours prior to each stage of <br />the project, a Qualified Biologist (see Measure 1.7) shall survey the project site at <br />the appropriate time of day for presence of special -status fish and wildlife species <br />that may be present. Only a Qualified Biologist with the necessary agency permits <br />and/or approvals may handle any State Species of Special Concern. This <br />Agreement does not authorize the take or disturbance of any species listed under <br />the CESA. All wildlife species encountered during surveys shall be recorded. <br />CDFW reserves the right to provide additional provisions to this Agreement <br />designed to protect special -status species. <br />2.23 Riparian Vegetation Modifications. Riparian vegetation modifications shall be <br />performed under the direct observation of a Qualified Biologist. <br />2.24 Wildlife Inspection Prior to Construction Activities Each Day. The Qualified <br />Biologist and Biological Monitor shall inspect the work area and areas adjacent to <br />the work area that will support motorized equipment prior to mobilization into the <br />work site each day. If the monitor determines the work site does not support <br />sensitive species, equipment may be moved onto the site under the observation of <br />the monitor. <br />2.25 Swainson's Hawk Avoidance. If project activities will occur during the bird nesting <br />season (February 15 through September 15) then the Qualified Biologist shall <br />conduct pre -construction nesting survey for Swainson's hawk within a'/ mile <br />radius of the project site. Surveys shall follow the Recommended Timing and <br />Methodology for Swainson's Hawk Nesting Surveys in California's Central Valley <br />(2000), available online here: https://www.wildlife.ca.gov/Conservation/Survey- <br />Protocols#377281284-birds. The Qualified Biologist shall submit results of surveys <br />prior to commencement of project activities. No project activities shall occur within <br />% mile of a nest occupied by Swainson's hawks. <br />2.26 Bird Nest Surveys. If equipment staging, site preparation, grading, excavation or <br />other project -related construction activities are scheduled during the nesting <br />season (February 15 through September 15) of protected raptors and other avian <br />species, a focused survey for active nests of such birds shall be conducted by a <br />Qualified Biologist within 7 days prior to the beginning of project -related activities. <br />Surveys shall be conducted in all suitable habitat located at project work sites, in <br />staging, storage and soil stockpile areas, and along transportation routes. The <br />minimum survey radii surrounding the work area shall be the following: i) 250 feet <br />for passerines; ii) 500 feet for small raptors such as accipiters; iii) 1,000 feet for <br />larger raptors such as buteos.
