Permittee shall not place spoil where it could enter State waters or other <br />sensitive habitat, such as riparian, or place over vegetation except as specifically <br />noticed to and accepted by CDFW, in writing. Spoil shall be hauled offsite or <br />stockpiled in an upland location where it shall be covered with plastic sheeting or <br />visquine whenever it is evident that rainy conditions threaten to erode loose soils <br />into sensitive habitats. <br />2.18 Vegetation Disturbance. No disturbance or removal of vegetation, other than that <br />included in the Project Description and non-native, invasive plant species, such as, <br />but not limited to, Scotch or French broom shall occur as a result of project <br />activities. No modification to riparian trees may occur until after Permittee has <br />achieved compliance with Measures 3.1 and 3.2. Vegetation outside the <br />construction corridor shall not be removed or damaged without prior consultation <br />and approval of CDFW. Vegetation may be disturbed only as specified in this <br />measure. <br />2.19 Coffer Dams. The Permittee shall construct a sheetpile coffer dam around the gate <br />construction area. Permittee shall coordinate coffer dam construction and <br />dewatering with a Qualified Biologist to perform fish relocation activities. Unless <br />otherwise approved by CDFW in writing, block nets must be placed at the upper <br />and lower extent of the areas where fish and amphibians will be removed. Block <br />net mesh shall be sized to ensure fish and amphibians upstream or downstream do <br />not enter the areas proposed for dewatering between passes with the electrofisher <br />or seine. <br />2.20 Daily Coffer Dam Checks for Stranded Aquatic Life. A Biological Monitor shall <br />check daily for stranded aquatic life in the dewatered areas. If a smelt, salmonid or <br />sturgeon is found within the dewatering area the Biological Monitor shall <br />immediately stop work and contact CDFW for guidance. Capture methods may <br />include fish landing nets, dip nets, buckets and by hand. Captured aquatic life <br />shall be released immediately in the closest body of water adjacent to the work <br />site. This measure does not authorize the take or disturbance of any State -listed <br />species. <br />2.21 Coffer Dams and Work Area Seepage. The work area shall be periodically <br />pumped dry of seepage under direct supervision of a Qualified Biologist of <br />Biological Monitor. Pumps will be located on barges adjacent to the areas being <br />dewatered. Any turbid water pumped from dewatered areas will be discharged into <br />an area protected by a turbidity curtain to prevent suspended sediment from being <br />transported upstream or downstream. Dewatering pumps shall not be operated <br />without this supervision. Alternatively, Permittee may place pumps in upland flat <br />areas, away from the stream channel. Pumps placed in uplands shall be secured <br />by tying off to a tree or staked in place to prevent movement by vibration. Pump <br />intakes shall be fitted with fish screens meeting CDFW criteria to prevent <br />entrainment or impingement of small fish and amphibians.
