".' <br />Mitigation Monitoring Program (MITIGATION MONITORING AND REPORTING PROGRAM: <br />CONSOLIDATED FORWARD LANDFILL PROJECT). The applicant and the Community <br />Development Department shall annually review the program. Not less than 30 days nor more <br />than 60 days prior to the first anniversary date of this approval, and each anniversary date <br />thereafter, the applicant shall submit to the Community Development Depariment a letter setting <br />forth the applicant's good faith compliance with the teons and condHions of the program. <br />Community Development Department staff will visit the sHe semi-annually. All costs incurred by <br />the Community Development Department forthe semi-annual monitOring and the annual review <br />shall be bome by the applicant. The costs may include costs of Community Development <br />Department staff and administrative time and direct out~of-pocket costs and expenses, including <br />costs of consultants and non-department personnel. Community Development Department staff <br />time may include overhead costs and will be consistent with Department policy. <br />g. MITIGATION MEASURES: The following mitigation measures identified In the Final <br />Environmental Impact Report: Consolidated Forward Landfill Project (SCH # 2001052081), <br />November 2002 are adopted as conditions of approval: <br />(NOISE) <br />(1) 6 (C.3) <br />Identified in EIR: <br />(a) Heavy equipment operations shall not be conducted within 1500 feet of any occupied <br />residence after 10 p.m. and before 6 a.m.; or <br />(b) Equipment operations within 1500 feet of any residence after 10 p.m. or before 6 a.m. <br />shall be fully shielded from the direct fine of sight to the residence by an earthen beon whose <br />crown elevalion exceeds the elevation of the top of the exhaust stack. .. <br />(2) 7 Forward 1993 (E3) . <br />The landowner and tenant at R1 (residence at 9690 AustinRoad) shall be provided with the <br />option of requesting a sound wall to reduce noise exposure both in the front yard and within <br />the home. Table III.E.B in the Draft ElR shows the noise reduction provided by a variety of <br />different sound wall desIgns. The footnotes to Table III.E.B describes the alternative designs <br />in detail). Note that any of these designs will be more than sufficient to reduce project noise <br />impacts below a level of significance_ <br />(3) 8 Forward 1993 (E1) <br />The contractor shall be required to employ the qUietest among alternative equipment or to <br />muffle/control noise from available equipment. , <br />(4) 9 Forward 1993 (E2) <br />Muffling of equipment used on site sha6 be maintained to factory specifications. <br />(5) 10 Austin 1994 (H1.a) (similar), Austin 2000 (H1.a) <br />The proposed project must conform to the San Joaquin County Noise Standards contained in <br />. the County's General Plan. The project sponsor shall be required to demonstrate compfiance <br />with this performance standard.
