A litter fence placed around the active face may be <br />helpful in correcting this problem. <br />Section 17751 - Periodic Site Review <br />The required periodic site review was due September 18, <br />1988. From the date of issuance of permit, at least once each <br />five years, the owner or operator shall cause a registered civil <br />engineer to review the site design, implementation and operation <br />plan to determine if any revisions are necessary and to estimate <br />the remaining site life. <br />NOTE: According to Mark Urquardt (Associate Civil Engineer), he <br />is currently preparing the five year engineering review and it <br />should be out shortly. <br />PLAN OF COMPLIANCE AND RESPONSE: <br />Section 17616 - Report of Disposal Site Information - <br />RESPONSE <br />The updated RDSI filed with the LEA on 1-13-89 contains the <br />correct operating hours, the updated resume of management, the <br />correct status of ownership and the handling of infectious waste. <br />Foothill Sanitary Landfill, Inc. is the owner and operator <br />of the landfill. Foothill Sanitary Landfill, Inc. has exclusive <br />use of the landfill premises for refuse disposal purposes pursu- <br />ant to a lease executed with the Lewis Family extending to and <br />including August 31, 2005. On June 3, 1988, and in violation of <br />a right of first refusal type provision in the lease, the Lewis <br />Family conveyed their interest in the demised premises to WMI <br />Waste Services, Inc. Such conveyance is subject to the Lis <br />Pendens filed February 29, 1988, and San Joaquin County Superior <br />Court Action No. 206021 filed by Foothill Sanitary Landfill, Inc. <br />On April 4, 1988, the County of San Joaquin initiated eminent <br />domain proceedings in San Joaquin Superior Court Action No. <br />206826 to acquire the Lewis Family interest. Waste Management, <br />Inc. is not the current owner of the landfill. Assuming resolu- <br />tion in favor of Lewis, et al, in both of the above actions, WMI <br />Waste Services, Inc. would be the owner of the landlord's <br />reversionary interest in the leased premises but not the owner of <br />the landfill. Until termination or transfer of the lease, <br />Foothill Sanitary Landfill, Inc. is the owner of the landfill. <br />.Infectious waste was previously handled at the site with the <br />approval of the LEA which in turn had approval from the State. <br />Jim Miller of the San Joaquin County Local Health District was <br />the person who received clearance from the State. <br />
