Rezonings applied for and granted in the vicinity are: <br />1) Rec. 544,545 to rezone to GA -10 and RA -15 were <br />withdrawn by the Planning Commission due to a <br />wide divergence of opinion by local residents. <br />2) Z-71-24, a rezoning, instituted by the Planning <br />Commission on August 27, 1970= this proposal was <br />effective as Ordinances 1745, 1757, and 1758 on <br />December 19, 1970. The Ordinance instituted <br />M-1, C -M, and RA -20 Zoning on land between <br />Waterloo and Cherokee Roads. This included the <br />subject property by easterly extension to the <br />line of Budiselich Road. The area of concern, <br />Sunny Valley Gardens Subdivision on both sides <br />of Cherryland Avenue south to Garibaldi Avenue <br />is zoned RA -20 by Ordinance 1745. <br />Use Permits: Use permits issued in the immediate vicinity <br />include 2 mobilehome parks with 42 and 72 units, a <br />private school for kindergarten through twelfth grade, <br />a 60' x 100' machine shop and two signs. <br />See also the Vicinity Land Use Map. <br />The property is within the area designated on the <br />Williamson Act Map as Metropolitan Stockton. It is <br />therefore not within any preserve, nor is it under <br />contract. It is possible to petition to establish a <br />preserve if the property owners desired to continue <br />using the land for agricultural purposes. However, <br />a minimum of 100 acres is necessary to establish a <br />preserve and therefore, 71 acres of adjacent property <br />would have to be taken into preserve concurrently. The <br />present application is not in conflict with the present <br />Williamson Act status. <br />Planned Land Use: <br />County General Plan Considerations: <br />The Land Use Element <br />Designation: Residential Suburban Density <br />Goals: To attain for all residents a living <br />environment which is safe, healthy, <br />stable, and pleasant, and one which <br />includes the desired cultural and <br />educational, recreational and shopping <br />facilities. <br />This subdivision is proposed in an older area which has <br />experienced random haphazard development.
