Mr. Todd Del Frate -2-
FINANCIAL ASSURANCES AT THE FOOTHILL SANITARY LANDFILL
Corrective Action
Historically, San Joaquin County has demonstrated compliance with financial assurance
requirements for corrective action by submittal of a certificate of Self -Insurance and Risk
Management. Upon recent review, we do not believe that this is an acceptable mechanism for
this category of financial assurance, and propose that we change the demonstration mechanism.
The appropriate financial assurance mechanism would be selected, in part, based on the
estimated cost of corrective action. The previous estimate of corrective action was developed in
1991, and is likely not to accurately represent the cost of corrective action today. to addition, the
previous cost estimates could not reflect the potential impact of the environmental control and
monitoring systems installed at the Foothill Sanitary Landfill since that time. Therefore, we have
initiated a revision of our corrective action cost estimates, which we anticipate will be completed
by July 31, 2006. San Joaquin County will then select an appropriate mechanism to demonstrate
financial assurance for corrective action, with completion of the necessary actions to implement
that demonstration by October 2006.
If any additional information is required, please contact James Moore, Engineering Assistant III,
at (209) 468-3066.
Sincerely,
W.
