<br />Enclosed, please find the required review and report of financial assurances for closure,
<br />postclosure maintenance, and initiating and completing corrective action, submitted in
<br />accordance with Provision J 12E of the above WDRs.
<br />C;lnsure
<br />Financial assurance for closure for the Foothill Sanitary Landfill is provided by an enterprise
<br />fund established by San Joaquin County's Resolution R-90-1190, dated September 25, 1990. In
<br />accordance with Title 27, California Code of Regulations, Section 22225, a demonstration of the
<br />minimum fund balance calculation must be submitted to the California Integrated Waste
<br />Management Board (CIWMB) by the anniversary date of the fund. The last report was submitted
<br />to the CIWMB on September 9, 2005 for the period of August 1, 2004 to July 31, 2005
<br />(attached).
<br />The Preliminary Closure cost estimate for the Foothill Sanitary Landfill was last updated in
<br />February 2005. For the September 9, 2005 report, the closure cost estimate was increased by the
<br />2004 intlation factor as required by the CIWMB. The report showed a closure cost estimate of
<br />$20,940,581 and a fund balance of $2,620,559. Per the CIWMB's response dated October 20,
<br />2005, the closure fund is adequately funded as of the fund anniversary date (also attachment).
<br />Postclosure
<br />Postclosure maintenance funding is provided by Pledge of Revenue Agreement 94-1137. The
<br />acceptance of this mechanism for postclosure financial assurance is also indicated in the
<br />attachment.
