Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's GASOLINE STATION <br />activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br />a. Failing to retain a copy of consolidated manifest for at least three (3) years, in <br />violation of Health and Safety Code section 25160.2(b)(3); <br />b. Storing hazardous waste onsite longer than one hundred eighty (180) days, in <br />violation of California Code of Regulations, title 22 section 66262.34(d); <br />c. Failing to have at all times at least one employee either on facility premises or on <br />call with the responsibility for coordinating all emergency response measurers, in violation of <br />California Code of Regulations, title 22 section 66262.34(4)(2); <br />d. Failing to maintain a copy of the modified contingency plan at the facility, in <br />violation of California Code of Regulations, title 22 section 66262.34(d)(2); <br />e. Failing to retain a copy of each signed manifest for three (3) years or until the <br />generator receives a signed copy from the designated facility which received the waste, in violation <br />of California Code of Regulations, title 22 section 66262.40(x); <br />f Failing to contact the transporter and/or the owner or operator of the designated <br />facility to determine the status of the hazardous waste within thirty-five (3 5) days of the date the <br />waste was accepted by the initial transporter without a copy of the manifest with the handwritten <br />signature of the owner or operator of the designated facility, in violation of California Code of <br />Regulations, title 22 section 66262.42(a); <br />g. Failing to submit an Exception Report to the Department of Toxic Substance <br />Control within forty-five (45) days of the date the waste was accepted by the initial transporter <br />without a copy of the manifest with the handwritten signature of the owner or operator of the <br />designated facility, in violation of California Code of Regulations, title 22 section 66262.42(b); <br />h. Failing to inspect areas used for container storage or transfer, at least weekly, in <br />violation of California Code of Regulations, title 22 section 66265.174; <br />-2- <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
