Failing to label containers as "drained used oil filters" and show initial date of <br />accumulation or receipt on each container of drained used oil filters, in violation of California Code <br />of Regulations, title 22 section 66266.130(c)(3); and <br />j. Failing to use a bill of lading to record the transfer of used oil filters, in violation of <br />California Code of Regulations, title 22 section 66266.130(c)(5). <br />4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's GASOLINE STATION <br />activities, are pursuant to Health and Safety Code section 25515.6 hereby permanently enjoined <br />from: <br />a. Failing to implement, maintain or to submit to the unified program agency, a <br />complete hazardous materials business plan, in violation of Health and Safety Code sections 25505 <br />and 25508, and California Code of Regulations, title 19 section 2729; <br />b. Failing to implement and maintain a business emergency plan for emergency <br />response to a release or threatened release of hazardous materials, in violation of Health and Safety <br />Code section 25507; and <br />c. Failing to implement, maintain, and comply with an employee training program, in <br />violation of Health and Safety Code section 25505(a)(4), and California Code of Regulations, title 19 <br />section 2732. <br />5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's GASOLINE STATION <br />activities, are pursuant to California Business and Professions Code, section 17204 hereby <br />permanently enjoined from: <br />a. Violating Health and Safety Code sections 25100 et seq., described in paragraph <br />3 -- 3j above; and <br />b. Violating Health and Safety Code sections 25500 et seq., described in paragraph <br />4 — 4c above. <br />6. Defendants shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS$5,000 00), <br />as and for civil penalties, pursuant to Health and Safety Code §25192. Said payments shall be <br />-3- <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
