No. 658 / Our Job No. 10050 (6213.5) <br />Dear Stacy: <br />As Authorized Agent for Costco Wholesale, Barghausen Consulting Engineers, Inc. is submitting the <br />enclosed documentation in response to the violations issued on November 8, 2022, for the Costco Gasoline <br />facility referenced above. The following items are enclosed: <br />1. One (1) copy of the UST Program Inspection Report dated November 8, 2022 <br />2. One (1) copy of the Return to Compliance Certification and Corrective Action Statement dated <br />December 7, 2022 <br />3. One (1) copy of the Overfill Prevention Equipment replacement permit issued on November 23, <br />2022 <br />The following outline provides each of comments in italics exactly as written, along with a <br />narrative response describing how the comment was addressed below it: <br />SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR Notice to Comply) <br />Item #214 CCR2712 Failure to comply with UST operating permit conditions. <br />OBSERVATION: The Overfill was replaced on 10/10/2022 and a permit was not obtained <br />from the EHD. Permit application was received late on 11/1/2022. <br />REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and <br />release detection may be performed by a properly licensed, trained, and certified <br />from the EHD. All other repairs must have a permit submitted to and approved by the <br />EHD prior to beginning work. <br />CORRECTIVE ACTION: Ensure site compliance with the UST operating permit <br />conditions. <br />This is a Class II violation. <br />Response:A permit for the Overfill Replacement was submitted on October 27, 2022 and issued by <br />Stacy Rivera on November 23, 2022.
