Training <br />records for 2019-2021 were not available for review during the inspection. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance <br />of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Ensure that oil-handling personnel are trained in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan annually. Submit a corrective <br />action statement to the EHD. <br />This is a Class II violation. <br /> 629 CFR 112.7(a)(1), 112.7(j) Failure to include in the Plan discussion of conformance with Federal and State <br />requirements. <br />OBSERVATION: Facility's Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to adequately discuss <br />conformance with all SPCC rule requirements, other effective discharge prevention and containment procedures, or <br />any applicable more stringent State rules, regulations, and guidelines. The SPCC plan dated 4/4/2019 did not <br />include a discussion of more stringent State rules, regulations and guidelines. <br />REGULATION GUIDANCE: (a) (1) Include a discussion of your facility's conformance with the requirements listed in <br />this part. <br />(j) In addition to the minimal prevention standards listed under this section, include in your Plan a complete <br />discussion of conformance with the applicable requirements and other effective discharge prevention and <br />containment procedures listed in this part or any applicable more stringent State rules, regulations, and guidelines. <br />CORRECTIVE ACTION: Ensure that SPCC Plan includes an adequate discussion of conformance with all SPCC <br />rule requirements, other effective discharge prevention and containment procedures, or any applicable more <br />stringent State rules, regulations, and guidelines. Submit proof of correction to the EHD. <br />This is a repeat violation, Class II. <br /> 705 CFR 112.8(c)(1) Container not compatible with oil stored and/or storage conditions. <br />OBSERVATION: The SPCC plan did not address oil compatibility with containers and storage conditions. <br />REGULATION GUIDANCE: (c)(1) Not use a container for the storage of oil unless its material and construction are <br />compatible with the material stored and conditions of storage such as pressure and temperature. <br />CORRECTIVE ACTION: Ensure the SPCC plan addresses compatibility of oils with containers and storage <br />conditions.
