MS-92-208 OF PRAKASH SINGH (C/O MONTE SEIBEL) <br /> (DISTRICT 4) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors deny the appeal and uphold the Planning Commission decision to deny <br /> Minor Subdivision Application No. MS-92-208. <br /> BACKGROUND: <br /> The applicant's proposal would permit the creation of two 5-acre parcels from a 10-acre parcel. <br /> The Planning Commission heard this matter at its meeting of November 5, 1992. At this meeting, Monte <br /> Seibel, representing the owner, spoke in favor of the proposal. There were no opponents to the project <br /> at the hearing. After considering all written and oral testimony, the Planning Commission voted 2 to 4 to <br /> approve Minor Subdivision Application No. MS-92-208. Since the application did not have a majority vote <br /> in the affirmative, it was deemed to have been denied. The reason for the denial of the application was <br /> the double flag lot design. <br /> On November 16, 1992 Monte Seibel, representing the owner, filed an appeal of the Planning <br /> Commission's action. In his appeal, the appellant stated that one of the Commissioners "could not <br /> support the proposed project because of the double flag lot access". He noted that the 25-foot wide strip <br /> is owned by the applicant and will serve only the two proposed lots. He stated the County ordinance <br /> allows a maximum length of one-half mile for a private road and it can serve a maximum of 6 homesites. <br /> The proposed length of the private road would be 1,005 feet and would serve only the two lots. He also <br /> noted that another subdivision that was heard at the same meeting was approved and the proposal was <br /> for 4 lots on a 2,000 foot private road. <br /> In his appeal, the appellant listed the following bases for the appeal: <br /> 1. APPEAL STATEMENT: <br /> "There is no double flag lot situation within the project or near the project. Both proposed <br /> lots will be served by the same access from Jahant Road. This existing 25-foot wide <br /> graveled road strip is owned by the applicant and will serve only the two proposed lots." <br /> BOS LETTER PAGE 1 <br />
