RESPONSE:
Presently, the 25-foot fee strip serves the existing 10-acre parcel. With the creation of two 5-acre
lots, there would be two lots served by the fee strip. Thus, two lots would be served by the
original flag lot configuration.
2. APPEAL STATEMENT:
'At the same meeting of the Planning Commission, the Ham Minor Subdivision was approved
where the proposed private road will serve 4 lots and the length will be about 2,000 feet. This
inconsistency of the Planning Commission to approve one project and denial of the next project
that has less impacts is incredible'.
RESPONSE:
Minor Subdivision Application No. MS-92-209 for Ham was heard by the Planning Commission
at the same meeting. The Ham subdivision proposed four 5-acre lots with a 25-foot private road
easement along the easterly property line of Parcels 1, 2 and 3. The private road aligns with Buck
Road and the Department of Public Works required an Irrevocable Offer to Dedicate and a
Deferred Frontage and Roadway Improvement Agreement for the 25-foot strip.
The Singh application provided access to Parcels 1 and 2 via a 25-foot fee strip to Parcel 1. The
Department of Public Works required an Irrevocable Offer to Dedicate a 25-foot wide right-of-way
along the easterly property line and Deferred Frontage and Roadway Improvement Agreement
from the southerly property line of Parcel 2 to the northerly line of Parcel 1.
FISCAL IMPACT:
None.
ACTION TO BE TAKEN FOLLOWING APPROVAL:
None.
Sincerely,
CHET DAVISSON
DIRECTOR
CD:LG:fa
Attachments: Appeal, Minutes, Staff Report
c: Prakash Singh
Monte Seibel
MS92-208.BL
BOS LETTER PAGE 2
