A letter from Dave Pechan was read into the record; the letter is <br />attached to Mr. Vacco's appeal. <br />The Planning Commission, in making their decision, found that the <br />division of the 12.24 -acre flag lot parcel into seven rural resi- <br />dential lots will have access via Fine Road from the west through a <br />proposed public road (Vacco Road). In addition, each lot in the <br />subdivision will be served by individual wells and septic tanks, <br />and a terminal drainage system will convey storm drainage to the <br />Fine Road drainage system. The Commission found the proposed sub- <br />division consistent with the laws and policies of the County. <br />Mr. Vacco based his appeal on the following two points: <br />(1) The primary access to the subdivision will be over property <br />owned by Mr. Vacco. Additionally, Mr. Vacco is concerned over <br />the potential that the County will condemn the property for <br />road purposes if he refuses to sell. <br />(2) The Planning Commission rejected a project condition for a <br />landscaping buffer between Mr. Vacco's property and the project <br />site. <br />Mr. Vacco's appeal issues were considered by the Planning Commission. <br />The Commission did approve the application subject to the proposed <br />road (Mr. Vacco's property) being acquired, improved, and dedicated <br />to the County. The Commission did not, and could not, commit the <br />County to acquiring the roadway but did indicate that the applicant <br />could request that the County become involved in acquisition if the <br />applicant was unable to purchase the property. The landscape <br />request by Mr. Vacco was not discussed by the Commission, and no <br />condition of approval was suggested.
