The water <br />stays on top of the soil. <br />June Connors, 998 Fine Road, Linden, asked about maintenance of the <br />drainage ditch. She said she would not want the water to back up onto <br />her property. <br />Mr. Lopez, representing Public Works, said that the roadside ditch <br />along Fine Road is maintained by the County. <br />Alan Victor, Third Avenue, asked about maintenance of ditches along <br />Vacco Road. <br />A letter from Dave Pechan was submitted by staff. <br />REBUTTAL: Mr. Seligman said there must be proper drainage; and they <br />are concerned about that problem without any development. He said the <br />County had not come out to the area to clean out the ditches for a <br />long period of time. It was at the insistence of Mrs. Lindberg that <br />the County did come out to help alleviate the problem. He said the <br />identity of Vacco Road was not their decision. Regarding Mr. Vacco's <br />request for a buffer, Mr. Seligman said his client is also concerned <br />about privacy. Regarding access, he said the public safety standards <br />would have to be implemented in regard to access. <br />Clair Vacco asked that she be noted as being present. <br />Comm. Bozzano said he had a telephone conversation with Mr. or Mrs. <br />Lindberg prior to this hearing. <br />PUBLIC HEARING CLOSED <br />Comm. Morri asked for clarification of some points made in the letters <br />from County Counsel and Public Works. <br />Mr. Lopez, representing Public Works, said that "facilities" refers to <br />a roadside ditch. As to payment of fees, he said there would probably <br />be an administration fee rather than a maintenance fee since the main- <br />tenance is already being performed. He said there are no facilities <br />to be maintained by a County Service Area. <br />Comm. Bozzano asked Comm. Gillispie to comment on the right-of-way <br />question. Comm. Gillispie said the right-of-way is a peculiar <br />situation. If the right-of-way had been required on the three lots, <br />it would have solved a major portion of the problem.
