Mr. Seligman said that on January 20, 1983 there was a Planning <br />Commission meeting involving this area and Mrs. Lindberg raised the <br />issue of her right to have access to her property by being able to <br />utilize her 25 -foot fee title strip and her 25 -foot recorded easement. <br />Staff has since said that she does not have access to her rural resi- <br />dential subdivision. <br />Chance Wong, Civil Engineer, was also present for the applicant. He <br />said that there are two subdivisions immediately south of the subject <br />property which were drained in the same manner as being recommended <br />for this project. Mr. Wong said that the additional drainage from the <br />subdivision will not be going onto the neighboring properties. He <br />also noted that the development.will meet the requirements for the <br />percolation tests. <br />OPPONENTS: Peter Vacco, 1150 Fine Road, said the back yard of some of <br />the proposed lots will run into his front yard. He asked for a <br />landscaping buffer which would also help decrease noise. He asked <br />about garbage disposal and who would pay for the street lights. He <br />objected to the name "Vacco Road." He said he did not give his per- <br />mission to use his family name on the road. He said the opening of <br />this road will increase traffic into the area. Mr. Vacco objected to <br />condemnation of his property in order to obtain access for the road <br />to Mrs. Lindberg's subdivision. He noted that eucalyptus trees are <br />planted in the 50 -foot fee strip which is on his property and he <br />wanted those trees preserved and maintained if that fee strip becomes <br />a public right-of-way. He suggested an alternative access - that the <br />25 -foot easement be obtained from the three parcels sold by Mrs. <br />Lindberg. Mr. Vacco went on to say that the water supply is suffering <br />from an overdraft. He said that drainage is a problem in the area but <br />he is willing to grant a right-of-way for drainage on the north side <br />of his driveway. <br />Comm. Carter asked about access on the other side of the road, as <br />suggested by Mr. Vacco. Mr. Seligman said that County departments <br />were not in favor of that. The location of the three houses are too <br />close to allow for a 50 -foot right-of-way because of frontage require- <br />ments. <br />Tom Solari, 21980 E. Third Avenue, Linden, said that a drainage ditch <br />was put in to drain Petersburg Subdivision and that ditch is not being <br />maintained by the County. The property owners are supposed to main- <br />tain it but this is not being done and the ditch is caving in. In <br />1982 there was a flood across Fine Road. The area in question is a <br />major natural drainage area; the water has always drained through <br />there; and if there is not a substantial drainage provision put in <br />that area, that property, and others in the area, will probably be <br />flooded. He said that as development increases, drainage problems <br />will also increase. <br />Patrick Roebling, 22069 E.
