PUBLIC SERVICES <br /> Background <br /> The developed portions of the Patterson Pass Business Park receive services from a variety of <br /> agencies. Water and wastewater treatment services are provided by the City of Tracy through a <br /> contractual services agreement signed in 1991. Other services are provided by San Joaquin County <br /> (storm drainage and sheriff's patrol) and by Tracy Rural Fire District. <br /> Water Service <br /> Water is provided to the business park by the Plain View Irrigation District.Raw water is taken out <br /> of the Delta Mendota Canal and treated at the City of Tracy's water treatment plant near the Tracy <br /> Airport.The treated water is conveyed to the business park through a 24-inch line that is owned and <br /> maintained by the City. <br /> The terms of the services agreement between Prologis(King&Lyons)and the City of Tracy require <br /> that the developer pay the City an annual fee in lieu of City taxes. The City will provide a treated <br /> water supply up to a maximum of 1.52 million gallons per day. As additional lands are developed <br /> within the business park, the lands are to be added to the services agreement and provided with <br /> treated water service. The services agreement states that the annual fee paid to the City is to be <br /> increased to cover water treatment and delivery costs for added lands. <br /> The Plain View Water District received approval in 1990 from the U.S. Bureau of Reclamation to <br /> deliver water for municipal and industrial uses. Prologis subsequently received a grant allocation <br /> from Plain View for a maximum of 3.43 acre-feet of raw water for each farmable acre of land within <br /> the District. All of the land within the Patterson Pass Business Park is now within the boundaries of <br /> the Plain View Water District, following annexation approval in 1996 by the San Joaquin County <br /> Local Agency Formation Commission of the remaining 168 acres outside the District. <br /> Excluding the 34-acre Tri-State portion of the Tri-State/Cheng parcel (which has not received a <br /> water allocation),Prologis(King&Lyons)has a total maximum allocation from Plain View Water <br /> District of over 1,500 acre-feet per year, or approximately 1.35 million gallons per day. The <br /> projected water demand for full development of the entire 610-acre business park is expected to be <br /> between approximately 800,000 and 950,000 gallons per day (see Special Purpose Plan, page 47). <br /> Thus, the Plain View Water District allocation should be adequate to serve all planned growth, <br /> unless the U.S.Bureau of Reclamation is forced to cut water allocation to Plain View Water District <br /> during drought years. <br /> The amendment of 218.5 acres into the Special Purpose Plan requires the issuance of a"will serve" <br /> letter from Tracy,indicating that the City has the capacity to treat the additional amount of raw water <br /> for the amendment area. An application to the City of Tracy requesting an amendment to the <br /> Services Agreement to serve the additional land will be processed concurrently with the Special <br /> Purpose Plan Amendment. <br /> 93231-90.spp00.wpd-2/24/00 -15- <br />
