As in the case of the water and sanitary sewer lines,a modification of the conceptual storm drainage <br /> collection system originally outlined in the 1994 Special Purpose Plan would be required to reflect <br /> the already constructed improvements and the site plan for the proposed ADT Auto Auction. The <br /> original alignments of the public loop road and stormwater lines to serve individual industrial lots <br /> should be deleted (Figure 11). Instead, a private storm drain system would be constructed to serve <br /> the entire site. The already constructed storm drain line running parallel to the Delta Mendota Canal <br /> would connect the detention basin with the other developed portions of the Tri-State/Cheng parcel. <br /> VISUAL RESOURCE ANALYSIS <br /> A visual corridor study has been completed for the proposed auto auction project. The study <br /> indicates that the visual effects of the project measured at three representative locations along the <br /> I-580 and I-205 freeways can be substantially softened and mitigated by planting of numerous trees <br /> to screen the project buildings. The site plans show the location of landscaping. <br /> BIOLOGICAL ANALYSIS <br /> Background <br /> As summarized in the Special Purpose Plan, the developer of the Patterson Pass Business Park was <br /> required to mitigate for potential impacts of development on two sensitive species,the San Joaquin <br /> kit fox and the burrowing owl. A Biological Opinion specifying mitigation requirements for the kit <br /> fox was issued by the U.S.Fish and Wildlife Service in September, 1991. Prologis entered into an <br /> agreement with the California Department of Fish and Game, which included the purchase and <br /> granting of a conservation easement for 627 acres of kit fox habitat.The developer was also required <br /> to construct four artificial nests for burrowing owls in the northern portion of the property. The <br /> Development Agreement and conditions of approval for the project call for periodic monitoring of <br /> the site and pre-construction kit fox surveys for all new construction. <br /> Recent Pre-construction Surveys and Monitoring <br /> Staff from the biological consulting firm of LSA (previously Resource Management International <br /> and WESCO) have performed numerous pre-construction surveys and periodic monitoring of the <br /> Patterson Pass Business Park area over the last nine years. Wildlife biologists have completed pre- <br /> construction kit fox surveys for areas south of Schulte Road and for lands west of Mountain House <br /> Parkway. During a daytime survey of Patterson Run on August 17, 1999,an LSA biologist spotted <br /> a kit fox along the bank of the channel. The sighting of the kit fox was reported to the U.S.Fish and <br /> Wildlife Service (letter of September 7, 1999 in Appendix A). <br /> Up until August, 1999, no other kit fox had been sighted. LSA biologists have conducted <br /> inspections of numerous potential kit fox dens (ground squirrel holes) and have monitored for fox <br /> tracks and have hand-excavated dens. The biologists have met with construction supervisors in <br /> areas of the business park that have been developed and have provided brochures describing kit fox <br /> protection measures. The LSA biologist notes in the letter to USFWS that "the project proponent <br /> continues to implement the protection measures for kit foxes as stipulated in the Biological Opinion <br /> in a consistent and conscientious manner and has maintained a high level of compliance with the <br /> 93231-B0.spp00.sspd-224/00 —21— <br />
