Pursuant to Health and Safety Code section 25286(a) and California Code <br />of Regulations, title 23, section 2712, Flying J shall comply with the terms of its UST permits. <br />4.5.c. Where Flying J learns that completed construction related to a UST <br />system materially varies from the scaled diagram or design submitted with the permit application <br />and approved by the CUPA, Flying J promptly shall submit to the CUPA accurate as -built scaled <br />diagrams or designs as required by California Code of Regulations, title 23, section 2711(a)(8). <br />4.5.d. Flying J shall have in place a monitoring and response plan approved by <br />the CUPA and specified in the UST operating permit as required by California Code of <br />Regulations, title 23, sections 2632(b) and 2641(g). If a monitoring and response plan has been <br />timely submitted as required by law but is subsequently rejected or disapproved by the CUPA, <br />Flying J shall work in good faith with the CUPA promptly to resolve any dispute. <br />4.6. Inspection for and Removal of Liquid and Debris <br />4.6.a. Flying J shall have a means for monitoring for any water intrusion by <br />precipitation or infiltration into the secondary containment as required by California Code of <br />Regulations, title 23, section 2630(d) and Health and Safety Code section 25291(e). <br />4.6.b. Flying J promptly shall remove any liquid or debris that has accumulated <br />in the secondary containment system pursuant to the maintenance and operating requirements <br />contained in California Code of Regulations, title 23, sections 2630(d), 263l(d)(4), 2632(d)(2) <br />and 2635(c)(6). <br />4.6.c. On entry of the Consent Judgment, Flying J shall have instituted a <br />.program for the regular inspection and maintenance of spill containment structures ("spill <br />buckets") and under -dispenser containment areas ("spill boxes"). The program shall require that <br />inspections occur at least once every two weeks and are documented; any accumulation of liquid <br />or debris discovered during these inspections promptly is addressed. Flying J shall ensure that <br />its employees comply with the spill bucket and spill box inspection and maintenance program <br />once instituted. <br />CONSENT JUDGMENT <br />10 <br />
