1 <br />4.8 Hazardous Waste, Hazardous Materials <br />2 <br />4.8.a. Flying J shall comply with its employee training obligations as set forth in <br />3 <br />California Code of Regulations, title 22, section 66265 16 pertaining to hazardous wastes, <br />4 <br />including its obligation to maintain training documentation. <br />5 <br />4.8.b. Flying J shall not treat, store, dispose of, transport or offer for <br />6 <br />transportation, hazardous waste without having received an Environmental Protection Agency <br />7 <br />Identification Number as required by California Code of Regulations, title 22, section <br />8 <br />66262.12(a). <br />9 <br />4.8.c. Flying J shall determine if a generated waste is a hazardous waste as <br />10 <br />required by California Code of Regulations, title 22, section 66262.11 <br />11 <br />4.8.d. Flying J shall not store on-site hazardous waste generated as part of its <br />12 <br />operations for a period longer than ninety (90) days without a permit as required by California <br />13 <br />Health and Safety Code sections 25123.3(a)(4)(b) and 25201(a). <br />14 <br />4.8.e. Flying J shall properly label containers of hazardous waste as required by <br />15 <br />California Code of Regulations, title 22, section 66262.34 <br />16 <br />4.8.f Flying J shall keep containers of hazardous waste closed except when <br />17 <br />removing or adding hazardous waste as required by California Code of Regulations, title 22, <br />18 <br />section 66265 173- <br />19 <br />4.8.g. Flying J shall maintain adequate aisle space in hazardous waste <br />20 <br />accumulation areas as required by California Code of Regulations, title 22, section 66265.35 <br />21 <br />4.8.h. Flying J shall retain copies of all consolidated hazardous waste manifests <br />22 <br />for three (3) years as required by Health and Safety Code section 25160.2(b)(3). As used in this <br />23 <br />Paragraph, "manifest" means a shipping document originated and signed by a generator of <br />24 <br />hazardous waste that contains all of the information required by law and that complies with all <br />25 <br />applicable federal and state regulations including, but not limited to, bills of lading. <br />26 <br />4.8.i. Flying J shall comply with its employee training program instituted <br />27 <br />pursuant to Health and Safety Code section 25504(a)(c) and California Code of Regulations, title <br />28 <br />19, section 2732 pertaining to hazardous materials business and area plans. <br />CONSENT JUDGMENT <br />12 <br />
